I was married 22 years.. X did not report he retired.. When found out.. I was awarded retirement award throught The military. and back pay and attorneys fees.. as he did not pay me for a couple years.. DFAS military is now sending the retirement pay..And Judgement was placed against my X for over 18,000. at 10 % interest. The military cannot collect back retirement pay.. only monthly out of his check.. Can he put this under bankruptcy.?




Your ex may include all his debts while filing bankruptcy and get a discharge from them. Nevertheless, it will be better to consult a bankruptcy attorney and take his opinion in this matter.

Not all debts are dischargable in bankruptcy Anna.

My thoughts are that this would not be dischargable....sounds like alimony or support....maybe we need more clarification? I think you should consult an attorney.

I don't think your husband will be able to include this in bankruptcy. Debts related to retirement plans are non-dis chargeable through bankruptcy. An experienced bankruptcy lawyer can give detailed information on this matter.
