Dealing with Asset Acceptance

Hi everyone. I have a small situation I would like some input on.

While my husband was taking care of bills, he started making 100.00 a month payments to Asset Acceptance.
Yeah OK. I didn't see any papers, stating the validity of the debt. Despite me saying we needed that he started paying them. That was 2 years ago. Last month he handed over the financial part of our marriage to me.

I wasn't as involved as I should have been so far. Which brings us to Asset. We have not gotten 1 bill, or 1 statement from them in almost 2 years stating what our balance is. I looked at our credit reports. On his there is not one thing on there saying he has been paying this debt. I am FURIOUS! :evil: They have been withdrawing 100.00 from our account every month without fail the past 2 years. I am ready to suspend any and all payments to them, until I get the information I want.

My only issue is I want to make sure we get can't get into legal trouble. His job revolves around his security clearance. Something like this will make it to where he doesn't get his clearance renewed. Which is what drove him to enter into this arrangment (in my mind) rashly.

Any thoughts? Has anyone been through this with them, or any other agency?

You won't fall in any legal troubles because you authorized Asset Acceptance to deduct money from your husband's account and they have been doing it regularly since the last 2 years. By this time, the account should have been paid or at least, the CA must have sent you a statement about the remaining balance. Call them and get the updates on this account. You need to make sure that the money got transferred towards your debt account.

Next time, when an agreement is done with any company, make sure that you have it in writing. This is to avert any possible disputes at the later time. Since you didn't ask Asset Acceptance to validate the debt, it is not sure whether they actually had your file to collect the debt. But, your bank statements prove that the company had been debiting money from your account for the past two years. It must have a valid and legal reason. If they can't clarify the debits done, take the help of your bank and put the debits on dispute with the CA. I don't trust Asset Acceptance because of their unfair collection practices. Many people complain against them for disputed account information and unauthorized debits. See this link for an idea about their business practices.
