HSBC and Charge Off

Okay, as most of you know I am fighting a couple of CA's regarding these accounts. I checked my credit report and it states both of my Household Accounts were charged off. This was due to my lousy debt settlement process but that's another story. Okay, payments have been cashed by HSBC on both accounts this month. I have paid nothing to the CA's because I am still waiting to hear back on the dv letters that I sent out over the past couple of weeks. I have also come to find out that both CA's are pretty shady and I'm meeting with a lawyer in a couple of weeks because one has violated the fdcpa six times already in my case. Should I stop making payments to HSBC as well? I am trying to find out if the CA has actually purchased the account from HSBC. Also, is it true that the CA has to supply the consumer with the purchase amount from the original creditor?


Keep doing your payments to HSBC. Be sure that the balance is coming down with your payments. Deal with the CA separately. You are sure about them violating the fdcpa. This gives you enough reasons to file a lawsuit. Even if they have the debt with them, the details should be first put in writing. And they will collect only the outstanding balance after all the payments done to HSBC. HSBC is accepting your payments; I will continue with it and won't be bothered to pay anything to CA.

There is no rule on providing the purchase amount from the original creditor. You may put a request to the CA but I doubt if they will give you this info.
