Washington Mutual Collection Agency Calling me at work

Problem 1: yesterday at work WAMU collection agency called at work but i was on lunch...is that legal for them to be calling me at my work?

problem 2: about a year ago...i was written a check for a LARGE amount. i did not know it was fraudulent. my WAMU account is still down in the hole. i had a police report of that person who wrote me the check. i sent WAMU an affidavit and they denied it.. what should be my next step? i shouldnt pay for someone's stupidity. please help. i dont know what to do about this.


As far as the second part of the question...once you endorse the back of a check, you accept ownership of that check. As far as the bank is concerned, you owe them that money. Even with a police report. Have to talked to their actual fraud department? If you don't get the answer you want, keep going up the chain of command. Start out by talking to one of the bankers in a branch, get them on your side, and they will totally go to bat for you and make sure they can take it as far as it can go. How long has your account been upside down? Is it even overdrawn right now?

WAMU is not yet confirmed that this debt is not yours. If you can prove to the bank that the check was never authorized, they may write if off.

Send a cease and desist letter to the collection agency. The letter is the only legal way you need to stop them from contacting you at work. Send it through certified mail with return receipt requested. Give them space to contact you only through mail, no phone calls.

In addition to a cease & decist letter, go visit your police department & ask about the case number they issued you. Have the official police report in hand if your going to try & talk with a WAMU manager.

Don't know your where abouts, but keep after the police & district attorneys too. I know it's tough to do. when you capitalized LARGE I assume it was well over the 150 dollar range.
