NCO portfolio manangement collecting for Sears

Does anyone know anything about NCO portfolio manangement? As they are trying to collect a debt on a sears card. Please help thanks.


I know they are shady!! I had one really nice guy work out payments, then on another account, no go, and they were hatefull...Karen

Yes, NCO Portfolio Management and NCO Financial Systems are the same company, and you do not want to work with them. They're among the worse of the collection agencies -- not the worst of the worst, but pretty far down the list. I urge you to send them a letter, certified mail and return receipt requested, telling them to cease communicating with you regarding the debt. Then work with Sears directly when your circumstances permit you to address the debt.

My suggestion would be to not deal with them at all. We dealt with them several years ago with our Capital One cards. They called and spoke with me 14 times in one day!!!!! The least amount of calls I received from them was 3 calls in a day. They even called me multiple times on the days I did make payments to them! They are liars and crooks.

I see many people on this forum recommend using cease and desist letters when there is another way. Multiple calls in one day can be a violation of the fdcpa. Don't run from NCO. If they do this to you, get a lawyer and assert your rights under the FDCPA to be free from debt collection harassment. NCO and others harass people because it pays. They know most people don't know the law or their right to be free from this kind of harassment.

Sometimes when you assert your claims under the FDCPA or your state laws, a collection agency will offer to forgive the debt as a quick way to get YOU to go away.

You do have rights as a consumer/debtor. Don't let anyone get away with violating them. It only encourages them to do it to the next person.

Thank you so much for all your replies I apperiate all of them I have a post in the debt consolidation and Settlement forum under a thread called Would Sears settle out of court? If you would like to read it. My husband and I are thinking its to late for us he was served a summons the collection is now under NCO for an old Sears bill. Any advice? Thank you.

My brother-in-law was being hassled by these scumbags last year about an old debt they had purchased from Ford Motor Credit. I sent (on his behalf) a Cease Communications Letter, threatening to report them to the fdcpa and to our State Attorney General's office if they persisted in trying to collect on a time-barred debt.

He hasn't heard from them since. How could he, since the debt was INVALID?

VALIDATE, VALIDATE, VALIDATE!

I am a collections manager for a university. NCO is actually one of the best collection agencies you can be placed with. Read up on your rights, know the language it makes a difference. Don't get me wrong, it's best to not be in collections at all, but they run a tight ship at least with governmental accounts. I would report any harrassment immediately to your AG's office. Just b/c you request for an agency to not contact you doesn't mean it will happen. There is literature in your credit terms or promissory notes, which by signing, you consent to.

collection agencies try their best to make you believe that you owe them, when you dont. It is nothn but a part of their business, they use every trick that is there on d earth to make you pay for the debt that u dont owe. Isnt it disgusting?

I completely agree with you, validation of the debt is d best way to deal with such pestering CAs. When you are asking the CA to validate the debt.. 9 times out of 10 you wont get a response at all. If they don't respond, or don't validate the debt properly, they cannot continue to make the collection activities. All we have to do is to be aware of our rights. So, that no CA can even dare to bully us.
