Make sure you go to the court with your papers and present your case to the judge. If you have nothing to pay this debt, there is nothing to lose.

Take the free credit counseling. You may figure out some options. The counselor will make lower repayment plans according to your situation. If this doesn't work, you may think about filing bankruptcy if that's the only choice left in your case.

I had my account with Capital one in a consolidation program and they tried to sue me any way as well. I guess they don't care and they just wanted their money sooner.

The best thing that you can do is try to work out something with the company yourself or show proof when you are in court that you have paid on the account. Do you have any documentation to show that you have paid on the account?

debt consolidation may not be the best route because they want their money here and now. However, contact a debt consolidation company anyway to know what your rights are. You might also want to contact an attorney to know what your rights are.

While I don't recommend it but in your case bankruptcy might be the best option at this point.

See. that's part of my problem. I can't come up with the money to declare bankruptcy. Besides, a bankruptcy would put my husband's job in jeopardy.

I sent copies of the papers to Superior, they said they will try to work something out with them. I just don't care anymore, I have been beaten down to nothing. If I go to court over this, the only thing I can tell the judge is I can pay $50 a month to CapOne, or go to jail.

Alexandra, when you say show proof I have paid on the account, do you mean the CapOne account or the one Superior has set up? I haven't made CapOne any payments since last year, because supposedly that was what the account with Superior is for. I have paid in well over $2,000 to Superior, but they took so much out for their fees that I have only $500 in their account, and they keep telling me that's not enough for them to negotiate with any of my creditors.

Get all of your paperwork from Superior together to show the judge. This will show that you are not trying to run away from your debts. You may be able to consult with an attorney in your area for free to get some advice on the situation.

Watch it with Capitol One. They are sue happy. Make sure you have all your paperwork in order and when you go to court and the judge sees what you have been doing, he is likely to rule in your favor. Also, I think you should consult with an attorney.

Some attorneys will work with you on the fees. When my husband and I had to file some years back, the attorney took a $200 retainer and let us make payments to him. He went ahead and sent letters to our creditors and when we were down to owning him one more payment, he went ahead and filed with the court. He dealt with all the creditors while we were making payments and when we would get letters, we sent them to him or phone calls, we referred them to him. Something to ask about and see if one will work with you.

i guess i have accounts with a lot of people, i have 3 accounts which i let got behind becasue of the paydaylaons i have one in good standing the other two are not but i am paying them off. i owe 44o on both i have made arrangements with them i owe with interest 600 by they are settling for 440 i guess thats something. i dont want to go to the courts if i can keep from it.

Ok, I have posted this concern several times and can't get any response back. I checked my CR and it says that as of Oct. 2003, the account was 30 days late. I haven't paid any pmt since then, so is that when the SOL started?? If so, wasn't it up in Oct. 2006?? (I live in NC and the SOL on open accounts is 3 years...)
