Collection Agency giving out personal info - next step?

I know this is a direct violation of the fdcpa 805(b), so what is my next step, if any? Obviously there's no proof, so in court it would be me and my mother's word vs their's. Is it worth it to do this or should I just go to my state Attorney General or what?

I doubt that you'd be able to win a lawsuit without harder evidence, but filing formal complaints with the appropriate bodies (including, as you say, the Attorney General) is a good idea. If this was just a one-time thing, there may not be anything else you can do about it, but if they contact your mother again, it would probably be worth recording the phone call -- after checking the recording laws in your state, of course -- and recording the conversation.

This is definately a violation but as stated not really enough to take to court.You could send a sternly worded letter to their registered agent regading law violation and that they may wish to pay you off then take a chance on court. This is basically a bluff unless you're willing to sue. To find their registered agent,look up secretary of state website in their headquarters state.
