I recently sent out a dv letter which stopped the CONSTANT collection calls 29 days ago (nco financial). I now got a dv response saying that "according to their records, the account has been closed".
On my credit report, the oc only shows a charge off and doesnt say it was sold.
how would i find out?

Easy way is to call them. You can also check on your CR's, if there is a zero balance, it has likely been sold. You can also request an investigation with the OC under sec 623 of the FCRA if you have disputed the TL with the CRA's and the dispute came back verified.

Ok. On the credit report there is still a balance listed still and it doesnt say it was "transferred to another lender" so I assume it still belongs to Capital One. This debt is over 2 years old, is it odd for an OC to hold on for this long?

Hah! I just called cap 1 and the automated message says they have "discontinue my account" and i should contact the "new owner". Being how I was getting calls from NCO until they received my DV letter, and the calls have since stopped and i received the "account closed" in the mail.. this is my first victory in cleaning up my credit!!!
I hope so, unless they [NCO] sold it to yet another CA. :?

well, considering NCO could not validate, anyone they sell it to would more than likely have a hrd time as well. So at the first least they cant sue me successfully.
Not really, unless they can validate it, and you are persistent
Not really, unless they can validate it, and you are persistent with sending those validation letters. That's one thing that bugs me though, these CA's sell some accounts over and over once they realize it can't be validated, such a pain. :?

Cap1 is not known for selling off delinquent accounts while still w/in statute. They are the elephant that never forgets and they keep excellent records so if it comes time to sue, they can produce the docs needed. They also never let you forget by reporting religiously every month. When was the last time the tradeline was updated? If it was updated w/in the last 30 days I would say they still own it and have assigend NCO to collect for them. Is NCO reporting as well? If it has been sold, you can dispute the accuracy of the TL, Cap1 will verify with new info ($0 balance, sold transferred to another lender). When was the last time you paid current on the account?
