I received a Summons through the County of Los Angeles from Brachfeld and Associates. I'm trying to find out if I need to use a form or just type a letter to respond. Either way, I need to respond as soon as possible. Is there a sample letter? Or is there a form I'm suppose to use? Please help.


Let me also give you certain steps that one can follow after being sued for small claims: -
??????? You can call up the collection agency and try to work out the things before going to court
??????? You can try mediation where you can try to resolve your disputes outside the court. These mediations generally lasts from half-an-hour to 2 hours.
??????? Don????????t forget to check whether you????????re sued in the right court (small or higher)
??????? Get ready for appearing in the court. You should be prepared for the following things: -

??????? If you really owe the money then try to settle the matter by preparing a payment plan with the collection agency before hearing.
??????? If the deal is struck with the collection agency then go for hearing

I used a template from another site...ihavebeenserved.info, the template that I used had a bunch of common defenses to credit card lawsuits, I filed it and my case was dropped. I was just served again on another credit card (past SOL...12 years since I last paid on it) but I plan to use that same template, it was very helpful.

i had this happen to me & I didn't respond, then I got docs stating that the arbitration was canceled and the judgement would be for the ca. I called the ca and worked out 3 payments with them in order to stop garnishment and when all payments were made the ca notified the court that the matter was taken care of paid in full. DO call the ca and work something out with them if you don't plan on responding to the summons, most likely they will work with you. If you get a judgement against you it will end up costing you more, you will end up paying for their attorney fees.
