866-489-0979 - this number from collection agency?

The number is 866-489-0979, they called and threatened legal action. I live in Alabama. I asked them for a faxed copy of documentation for my records and she said that she could fax in one hour and I had two hours to wire my money. I did not wire any money because she never faxed me the documents. She called and left a very threatening message that she was pursuing legal avenues. I contacted my local DA's office who referred me to the sherrif and they told me that they can threaten all they want but this is a civil matter that would have to go thru the proper legal channels. I am terrified. If I owe fine, send me documentation. Am I doing the right thing, please tell me......HELP


I have sent the cease and desist letter to them as well as going as far to fax and e-mail it. Guess what? At 830am they were on the phone trying to intimidate me with threats of a lawsuit and other such things....I calmly requested that the present me with proof that I took out the loans in question and they REFUSED stating that it was my job to prove I wasn't the borrower...they wouldn't even give me the account number(s) in question......any other ideas?

I haven't figured out who these people are yet, but over the weekend we figured out that they took money out of our account!! When I called to find who they are..... they got nasty and hung up on me!! Who are these people and how did they get my account number??

They took 400 out of my account on friday and i called the bank that same morning. Filled out a fraud paper and I hadmy money back in my account this morning. Thank god. These people are crazy when i called to find out who they were the guyon the phone heard my kids in the background and told me that i should not be a parent because i used the word he*l on the phone. They had me so mad.

Talk about comical! I am in litigation with them now. We (my attorney) are suing them for the same bullcrap that everyone has listed. I listed my past issues under a different name to protect privacy. THEY ARE SCUM SUCKING, LYING, LAW BREAKING THEIVES.

Since they're in Kansas they procured a PERSONAL INJURY lawyer to defend them here. Even her name is hilarious.

We're going back and forth in the settlement process and we're going for their balls. I've already turned down two settlement offers. They KNOW they screwed with the wrong person.

To everyone else, I suggest you procure an attorney who specializes in collection agency wrongdoings on contingency.

What do you have to lose?

knaill1978 - I got in an argument too at the beginning of this whole fiasco.
He called me "immoral". HAHA! I told him to look it up in he bible, money lenders were looked down upon, therefore HE's the "immoral" one.

Of course he refused to disclose their address. He asked why I want it and I told him I was sending a "debit validation" letter because I know the laws. He says "ooooh, since you know the laws, you must not pay your bills". JEEZ. I got fed up with his ignorance and told him all further communication must be in writing. He said "just you wait!".

I waited. No more contact from them.

PLUS, can I give people a tip? USE YOUR CALLER ID. Don't bother answering 800 numbers, unknowns, blocked calls or funky area codes.

Wow! I just got off the phone with a James from Smith, Haynes & Watson. James called me at work, again, after I had asked him not to. He is very rude, condescending and arrogant. I asked for a mailing address but the only mailing address that they have is a PO box and it's for bankruptcies only. WHATEVER!! We went round and round and finally I got a fax number to send a validation request to. When I told him that he was in violation of fdcpa, he just laughed at me and said it was "all he said she said crap." This is unbelievable! To the person suing them, I wish you all the luck! Put it to them!!

these sharks are no law firm they are a collection agency using unfair collections practices if you have the oppertunity to record your conversations please do so then contact a local attorney that handles fdcpa law they will represent you for a % of the fine imposed on them fyi they handle several payday loan companies the are owned by geneva roth goggle that name it will give you more than enough documentation on this unscrupulus company

ok fyi these people are collectors they make their living off scaring people into submission you can send them all the c&d letters and all the vd letters you want it will not stop them if you look at their posting for jobs it shows that they are located at 6950 w 56th street kcks 66202 the po box is their way of hiding the only way to get rid of them is to document your case well record all conversation you have with them all letters you send to them send them ceritified return reciept to their physical address keep your reciepts on whom sighned for them record your calls they are using illegal tatics that is why they dont care they have foud out that they can throw a little cash at the one that do sue them for unfair practices and make millions from the one that do not the only way to get rid of them is to hit them in their pocketts going to your original creditor will not work because they own the payday loan company that you borrowed the money from geneva roth antilles ezloan what ever name they make up this week it changes day to day or week to week the guy that owns the company name is mark ask to speak with him and watch them scramble .......it kind of fun ........lol.......well good luck and happy hunting

I am unfortunately going through the same issues with this company. I wish I would've looked them up before giving them my bank information. I still need to pay the debt though or else it will just end up on my credit report. I think I still might follow the advice that was given on this. I know I owe money but I didn't think I owed as much as what they were saying. They told me that I had to give a $300 payment up front and then after that weekly I will have to give $50. That is the payment arrangement I set up with them. I actually don't know what I should do now. I don't know if I should continue with the payments or not? Any advice?

Any updates on legal action against this company? I was debited $145 today and honestly don't know what it is for. I will send the letters out immediately and contact the best damn lawyer in this state(Virginia) to go get em.

I beg to differ they can not threaten you or use scare tactics, they also can not tell you that they are taking legal action or have already taken legal action when they indeed have not nor do they intend to. If they are not willing to validate who they are or the debt owed, do not give them any personal information. You are protected under the FDCPA regulation laws, these laws protect you against people who use these tactics to get money from you. They protect you so well as a matter of fact that you can sue them for breaking these regulations and owe them nothing in the end. Tell them you will be contacting the FTC which is who handles FDCPA regulation violations and the Attorney General's office about their tactics and watch how cooperative they become, hope this helps and good luck.
