collection calls

What is the law on when a collection company can call? My b-friend has sent in a payment for closure of an account over a month ago with Conn's, Beaumont, TX. It was a certified check sent from the bank to them. They have been calling him many times a day-at home, at work, etc. Cursing him out saying that they are going to put this on this credit report. I would classify their phone calls as harrassment. He has even gotten the bank and one of their own store managers to work with him to get them to understand that the certified check was sent by the bank. I have even seen it where they have called him not only once in a five minute period, but several times because they do not like that he says he has already paid him off.


If it is with Conn's and Conn's is the original creditor, then the FDCPA doesn't cover it unless you have a state one. I'm assuming that you live in Texas, and I've looked through the Texas Finance Code and I do not believe that you have much to go with here, and I am pretty sure Conn's will just ignore your C&D letter.

Someone will correct me if I'm wrong.

Okay, I did some digging for ya. Do as Soaplady said, send them a copy of the certified check, i'd also write a letter to one of the Exec's and include the certified check and account # etc. Let them know that the bank has talked to collections department, Cs however they still continue to call, and how much stress this has caused you & your bf, and that your bf has developed health issues related to their continued calling on a paid off account.

Send the letter CMRR just as you would a C&D.

Not sure who you would complain to at the state level. But i'd start with the company Exec's.

I say report them even if you already sent the payment. They should not have the freedom to do this to you!
