Not sure what to do now with Capital Management Services ?

I sent a DV letter to Capital Management Services in Buffalo NY in response to their request for payment. Seems they bought some debt that is supposedly mine from arrow financial services.

Well, after receiving the letter, I checked my credit report and I didn't see anything with Capital Management Services on it, so I sent the DV letter. This was well over a month ago and I hadn't heard anything from them.

After reading thru this forum, I realized that Arrow Financial is somehow tied to NCO - which IS showing up on my credit report. I've been trying to get that removed from my report forever, with no luck, and my only consolation is that the SOL is up on that in September, so I finally gave up and decided to just wait for it to drop off.

Yesterday, though, I received a letter from Capital offering me a settlement on the account. I thought that they were not allowed to pursue further collection attempts until they had satisifed my DV request - am I wrong about that? Any advice would be welcomed - I don't know whether I should respond? Should I send another DV? I didn't send the first one certified, which I now know I should have... I'm just not sure what to do. Thanks!


yes,that is continued collection activity.once they get your DV letter there is no time frame to validate,but they have to cease all collections until the debt is validated.re-send the DV letter with an added part stating that they are commiting fdcpa violations by contacting you without validating the debt.
