I called Checkmate collections today to tell them the account is closed and both my husband's and my check will come back to them and that I needed to make arrangements. The person was very rude, stated the minimum they can do is half of what's owed next paycheck and the remainder the following. I suggested $50 per month and she said no way and that I was telling her I wasn't paying and I said again that I intend to pay but can't do half and half. She stated she was disconnecting the call and was contacting my employer to pursue the check. I know this is bull. She can call all she wants but can't garnish wages w/o a court order. T & C will be starting this week as soon as I send their retainer. Any advice on what to do next with these people?

send them a letter stating what you tried to do over the phone. When faced with the choice is trying to collect more or taking what they can get, they will likely accept it. Don't let the rude ones get you off track. stick to your guns and they will work with you (they wilol complain, scream and stuff but they will work with you.

I read my contract and there is no voluntary wage assignment which is what I thought anyway but I had called Checkmate "collections" today as a courtesy to tell them the account is closed, they will get the check back account closed and that I needed to make payment arrangements. After stating this and making offer (I will let T & C actually do the proposal and send payment, etc.) she went off on me and stated that I was refusing to pay the loan (why would I call if I was refusing to pay???)and that she was disconnecting the call and contacting my employer to pursue the check. Can I/should I report this to DFI/AG if she is threatening this? I'm sure she didn't call and it was a scare tactic anyway. I don't have any proof but it really pissed me off that she treated me that way and I thought I was doing the right thing by contacting them! Can't win for losing! Should I let it go or pursue it only if they start harrassing or threatening further? I'm in AZ so I know I could record calls. Too bad this one wasn't.

T & C is Town and Country Acceptance Corporation. They are a debt management company that helped me with all my payday loans. I would highly recommend them if you don't feel comfortable handling the payday loans on your own.
