about a year ago after i got married and more of my information
about a year ago after i got married and more of my information became public, i got a phone call from them. regarding a past account from 1998, that i had long forgot about and thought was taken care of. but of course they said i still owed money on it and i talk to a girl a few times and made payment arrangments with them and then i missed one payment around christmas and then they filed a law suit against me and now i have a judement against me for them and i have to make monthyly payments and once again i am having financial difficulties and they don't give a crap and said if i miss a payment then they will take further legal action against me..i wonder what that is considering if i have no money they can't take it and i own nothing, so i too have to deal with them. They will continue to harass you until they get what they want and believe me ignoring them doesn't work either. they are vicious and mean people to try to work with and they don't care of anything but getting thier money..
As far as the phone calls i'm not sure if you can, but i would call the phone company and see if you can block their calls, let me guess they call you at least 3 times a week..I hope things work out for you i know how annoying they can be, i am still dealing with them...

I am thinking that you have not done any payment towards this account in the recent times. As this is a very old account, it is out of the SOL period and seven years reporting period. Check the latest copy of your credit report if the CA has hit any negative remark in your file. Under the FCRA laws, they are not authorized to report anything without legal reasons. Know the fdcpa laws on how to deal with such collection agencies. Asset Acceptance must not violate any of the federal laws mentioned here.

Asset Acceptance must have sent you the details of the debt in writing before attempting collections. This proves if they are authorized for the collection of this account. If nothing has been sent to you in writing, send a debt validation letter to their mailing address. After receiving your letter, they should not contact you until everything has been put in writing. Read this page for more information on debt validation.

Samples of debt validation letter are available in this site. Send it through certified mail with return receipt requested. Once you have got the details in writing, notify them about the expiry of SOL on this account as per the laws, thereby stopping all collection attempts in the future. You must be confirmed about the expiry of the SOL before sending the notification.

How old is the debt account? You can send a cease and desist letter and stop Asset Acceptance from contacting you further. Send the letter through certified mail so that you are sure about the delivery. The green receipt will confirm the receipt and if they try to contact you later, it will result one of the fdcpa violations. Read this law in the FTC website.

This is out of statute of limitations and it should have been over your credit report. It sounds to me that they have somehow reaged the account to collect. Do not send them anything til you have validation from them. I would recommend contacting an attorney on this matter.
