Technically no. Was there any stiipulation with the dismissal about the debt being re-sold? Was the case dismissed because the plaintiff lacked documentation? If so, then it is unlikely that any subsequent JDB would have any better luck. Has the statute of limitations for your state expired?

Thanks for your reply, The case was dismissed because the lawyer showed up with no proof of the debt he was hopping I wasn't going to show up. The judge gave him 20 minutes to make some phone calls to produce something and he came back and told the judge he didn't have anything. as far as the stibulation all it says dismissed with prejudice. My advice, show up in court and request a discovery when you send your answer, 99% of the time they will not be able to produce a contract. these debt collectors hope that you will not show up so they can get a default judgment and garnish your wages, you have to fight back .

It's possible they'll sell it on down the line to some "poor, unsuspecting" JDB who might try and file suit but as I stated earlier, odds are against them having any more documentation than the original plaintiff.

I thought dismisal with predjudice meant you could not be sued again for the same debt. Maybe it just means that current debt collector can't sue you again which stinks because that gives them the option to sell it and then you start back at ground zero again.
