LVNV Funding and now Gulf State

Hello,
I sent a DV letter to LVNV on Sept. 18th. No response. I got a call from Gulf State today. Does this mean they cannot validate and are passing it around. I did talk to the man from Gulf State. He was very nice and told me to fax him a letter saying this debt was paid through Sherman. Is there a catch to this? I don't have anything from Sherman saying it was settled. Trying to get in touch with the lady that handled the Sherman account but no luck yet. What should my next move be? I just can't see them taking my word and closing the account by faxing them a statement saying it was paid. Thanks, Cathy


I just got the first call from him today. Guess I'll be getting a letter next. I flat out told him this debt is paid and I will not pay anymore on it. I also said you can pass it around to your affiliates but it'll do you no good. I told him not to call my house again. I hope I didn't say the wrong thing but didn't want them to think I would even consider paying. He was very nice. Even said he believed me and to just send a fax stating it was paid. I will send out a C and D letter. I just sent one to LVNV Funding on the 18th. Will I have to send one every few weeks or is there something I can send that will stop the calls and make them all communicate through the mail? I will have to get my credit report. It's been a few months since I've looked at it. If it says paid will I be able to use that against the other collectors? Thanks, Cathy

In most cases, collectors pass on the disputed files to others after they are legally restricted from contacting you. Maybe, LVNV Funding has hired the other company for collections. You requested validation from LVNV Funding, now you will have to do the same on the person from the Gulf since he is the one contacting you. Cease and desist rule will apply on him too. Check your report if you can find anything about the status.

I pulled up my credit reports and LVNV is already on there. Sherman is no longer on it. I remember disputing it and had it taken off. Guess I should have waited to see if it would have reported paid. I will dispute LVNV if they don't validate and it doesn't look like they will since they've already passed it along to an affiliate. If getting Sherman off was easy surely it won't be hard getting LVNV dropped but who will be next? Will I have to keep disputing every month? I am faxing Mr. Jordan a letter stating I have paid this account so please stop collections and update my account. May not do any good but that's what he said to do. I will send a C and D letter next. Thanks, Cathy

I'm afraid my problem will be we settled the debt for less and she never sent me a letter stating the fact. They are trying to get the difference now. I have tried to call the lady at Sherman's but no answer and her voice mail is full. I wonder if they do that intentionally.

Cathy, I had excactly the same situation. I also settled the debt for less and never got a letter stating that fact. Years later I received a letter from a CA looking to collect the difference. When I called the CA I was treated very rudely and was told I needed to provide that letter. Or pay up. That is when I first came to this website. My original agreement was with Algeis Group, which I understand now is Sherman. I did find my check for what I assumed was my final payment(dated feb-2001). I too tried to call the girl I had the arrangements with, because I kept all that info, and had the same results you did. So what I have done is sent tne CA a debt validation letter CMRR. That was about 6 months ago and I have heard nothing since. Come feb2007 if I understand correctly, they will have no legal right to collect this difference. My guess is they cannot provide me what I am looking for, so up theirs. Maybe you could try the debt vaiidation letter. Whatever you do DON'T make a payment.

I will send a debt validation letter to Gulf State and hope they can't validate. LVNV passed the debt over to them within a two week period after I sent them the letter so hopefully that means they have nothing. LVNV is on my credit report but I had Sherman removed so hoping I can get them off too. What a mess. Thanks for letting me know they did the same thing to you too.
