National Enterprise System is a Collection Agency and it is bound to follow the fdcpa rules. They can't cease your bank account and nor do they garnish your wage. For a synopsis of a Collection Agency's limitations please go through Fair Debt Collection practices Act - FDCPA.

I got a call from this company today..The first woman I soke to was Ok..Then after being on hold this guy comes on the line was a real jerk tell me he does believe I have no family I can ask for the money. My husband just passed awat 15 days ago and I have three kids to support etcI tried telling him my situation and he stated they would cease my asstes garnish my wages and etc. Then He so rudely said if you think you are having a hard time now wait until you have to pay lawyers and court fees which would be over 6,000.00 just wait you will really be having a harder time...when I asked his name he would not give it hmmmmm. what a jerk

I received a call on Thursday at work. I told them that I was not allowed to get personal calls at work. The woman told me that this was the only way they could reach me and to deal with it. She was soooooooo incredibly rude!!! She demanded I leave my desk! I told her I was on a land line so how could I leave my desk!!!She continued to harass me until I was in tears.
I was off work the following day. They left a detailed message about my debt on a co-workers voice mail!! They called my supervisor and told her she was a liar when she told them I was out that day!!!! I am filing a complaint with the Ohio Attorney Generals office!!!

Bootzlh, I would save that phone message and file those complaints!

Send them a limited C&D letter and that tells them to contact you ONLY at home and by US mail only!!

This company is something else. I filed a chapter 13 bankruptcy over a year ago and at the time, allied interstate had the account. They did not file a claim within the 90 day bar date, so they will not be paid. Well, the other day, I received a letter in the mail from National Enterprise, demanding the payment in full. I call them and some man starting screaming in the phone saying I better pay or else. I told him, he needs to tell my attorney and the bankruptcy trustee that. Needless to say, he will not tell them that because he is trying to collect on a debt that is basically considered discharged because when Allied Interstate had it, they did not file a claim.

Now that I think about it, this man even told me that bankruptcy will not protect me and he will get his money :evil:

ROFLMAO!!! What an idiot! I bet that man is from overseas and doesn't understand the purpose of bankruptcy protection. If he is from the US, boy, he really IS an idiot!

If you hear from them again, I would file a claim for FDCRA violations. Sounds to me like you can probably sue for $1,000 for each infraction. If I am wrong, would someone here correct me. Thx.

I have to say I was releived to see that other people were having the same problem with this company. They are using scare tactics!! This isn't right!! I did file a complaint with the Ohio Attorney General's office. I couldn't believe how easy it was!! Maybe if everyone stands up to them something will be done about this!! They are continuing to call and have me paged at work!! I have had to tell co-workers my business so I can screen my calls and not get in trouble!!

I had a call from them today. The man was terribly rude and threatening. I asked to speak to his supervisor and he said he is the director. He told me that I shouldn't be worrying about things like who he is and that I should be taking down pertinent information. He told me my money was nothing to him that he is very successful and he could throw away the amount of money that I owe. He threatened to have the sheriff at my door by Monday. I filed a complaint with the FTC. Hopefully they will crack down on them. I took down all the names and numbers that I was given and gave them all to the FTC.

I also received a phone call from this company, he was very rude and said that if we didn't pay or set up an arrangement he would have a sheriiff come and serve us to appear in court. I am wanting to pay but at a little more reasonable plan then all the money up front or in 2 payments, but they will not work any thing else out. So he told me that this would go to a lawyer in my state and they would get the money from us. He also said that they pulled our credit and we have an open line of credit to pay...I don't know who's credit he was reading but it wasn't mine that has an open line. I also was told they would garnish my hubands wages.

What state do you live in? When was th elast time you paid on the account? Have they mailed you any correspondence regarding this debt?

I just received a call from this company on my fax phone line. The person they were looking for does not live here and does not have access to this phone number. The woman I spoke with was angry, rude and threatening. I told her she had the wrong number but she still threatened me. She asked if I knew the person they were calling about. I told her it did not matter if I knew them because this was not their number. She would not hang up the phone. She said they would continue to harrass me until I gave them the information they wanted. I finally had to hang up on her. These people are loose canons!

This company sent me a letter demanding their money. The account is included in my chapter 13, but they will not be paid because a claim was not filed, but what I wanna know is, how did this company get my mom's address? The letter was sent to my mom's, but I do not live with her, and she just moved to the address where they sent the letter just a couple of months ago.

Mlm, when you say that the account is included in your Chapter 13, does that mean that the creditor was notified of your BK filing? If so, then they have violated the automatic stay that is designed to protect you from further collection attempts. Since it's a Chapter 13, I would think that you have an attorney? You should give a copy of that letter to your attorney so that he or she can deal with National Enterprise Systems.

How they got your mom's address is a good question, but they seem to have their ways . . .

Yes, I have an attorney for my ch 13. I did give them the letter that National Enterprise sent me. They are trying to be slick because, when I first filed, allied interstate had the debt. In a ch 13, a creditor has 90 days to file a claim from the date my case was filed in order to be paid. Well, Allied Interstate did not file a claim so the debt is considered discharged because no claim was filed. A year and a half later, National Enterprise is trying to collect on the same debt, which they can't do because it is considered discharged because Allied didn't file a claim. I guess maybe they think I'm stuck on stupid and would give in and pay them, but their wrong. I gave a copy of this letter to my attorney and the bankruptcy trustee so they can handle it. It just has me puzzled, because I'm wondering how they got my mother's address.

Ane yes, it certainly is a mystery about your mom's address. Did she purchase a new home? If so, they may have done a search of property records.

I have never encoutered ANYTHING like this in my life . This woman ( allegidly Mrs. Moore , ext. 1018 ) was screaming at me , insulting me, and threatining me.

She has been calling me for 3 days all day long , she wouldnt let me get in one word. She told me she was a lawyer which is obviously untrue. She tolf me she was noting "refusel to pay", which is also not true, unless I paid in full immedaitly, SCREAMING , i mean reallyyyy screaming.

She said a payment plan was out of the questions and demanded my banking info, which of course was not going to happen. She threatned to have someone come to my workplace. I finally called back and got a "compliance supervisor " I told her I was on a recorded line, she gave me a complaint reference #, and I will be filing a formal complaint, even though I have a feeling the compliance dept does not exist.... but I checked my account online and it actually let me make a payment to Macys , so I did, Thank God I was able to do that.... this was yesterday ,

When i explained i was personally dealing with Macys NES compliance dept. said they put my case "on hold", i guess to see if money was really going to be paid...

Laura....were you really on a recorded line? Can you get a copy of the recording? Forget class-action....you have a case against both the CA and the OC. OC's can be held liable for the actions of a 3rd party collector they contract with. If you have the documentation. Granted, it's only up to $1000 per action for fdcpa violations, but the message it sends..... :twisted:

They threatend legal action, brought up bills of mine that have nothing to do with them, brought up my credit situation, told me I never pay my bills and were down right condisending and rude to me. If you are filing BK, don't talk to them. I'd change my phone number if you can.

I have Been harassed by this company telling me that i have to pay the amount in full by mid November or else they are going to take legal actions and send judgment papers to my home. They have my wife worried every time someone comes to the door that they are trying to serve us papers which i know they have no legal right by just being a collections agency. The origanal creditor has to file to suite with the local debt collections office. I am in utah. I know i live in a state where i can record a phone conversation with 1 party consent. I am with any one that has enough information to take this ignorant SOBS down to size. We need people to stand up for their dignity. We need not to let these SOBS walk all over us. They are cowards. i was told to forget about all my other bills they wont sue me but they are down and determine to do so. I say bring on the Blazing guns . Lets fight fire with fire.

I spoke to a "Bob Thompson," I've found another web site with complaints about him. Rude and wouldn't give me info. So, I hung up on him. They bought a company that bought it from CIT, which had an account of mine. I am in the process of filing chptr. 13 and they were given my attry info before.

if you already gave them your attorney's info, then they are breaking the law by continuing to call you and harass you. The only way the law allows them to continue calling you is if they have tried to contact the attorney but have not been able to.....better look into the FDCPA violation there, it's worth up to $1000 in your pocket...

THEY DID THE SAME THING TO ME. DEMANDED 2 PAYMENTS ON ALMOST 8000 DOLLARS OR FURTHER LEGAL ACTION WOULD PERSUE.
