10 year old debt just popping up

Back in June we applied & received our FREE credit report from all 3 companies. Shortly after that I began to receive a phone calls from NCO stating we had an outstanding debt from 1999 with MCI. I was fairly sure we had paid that all off but did not have any records so I called MCI & they told me that no we did not owe, we were in good standing & what not. They recommended I get a debt letter from NCO. I have repeatedly requested this from NCO & only recently received the letter. I re-called MCI & now they say “Oh Yeah you owe. We sold it to this company & then this company got it & blah blah blah”

A debt is a debt & I do not mind clearing it up but my question is this: It is not showing up on our credit presently but when I pay it will it reappear? How will it reappear, negative? The amount was for $229+ & NCO is saying I can pay them $60+ to clear it. Do I need to get any letters from NCO?

Actually NCO is doing this for another company LNVN. I am a bit baffled with all this & what to do right & not get us in a whirlwind all over again.

I would be extremely leery of NCO and was that LVNV? Both those companies are class act jerks who routinely violate the law left, right and sideways. I would be doubly suspicious because initially MCI had no knowledge of you owing, and now they say you did? Something smells fishy. I would immediately DV NCO, make them prove up this account since you are sure you paid it. Do not let them try to make you prove anything, it is all up to them. Demand to see the statements (for the life of the account) and make sure they are not adding bogus charges.

I am sorry, it is lvnv funding llc. All these "letters" of the collectors gets a bit confusing sometimes!

Just recently did I get NCO to tell me that the bill was sold to a collection agency, LVNV. Each call they have made to us I have spoken to them. And just recently did they actually send me a letter about the debt. The letter does not say much. Gives prior MCI account # & account # for LVNV. No date of bill. Thou MCI tells me now that it was sold in 8-99. I was upset with MCI telling me we did not owe then now yeah we did owe. I guess the account # helped them recall.
When I speak to NCO on the phone they have the payment I can make to them getting lower & lower ( felt like if I talked enough then maybe it would be gone eh! ) but the letter tells me I have 45 days to pay $137.45 lump sum settlement.

What is a CD letter? I can get the statements from the life of the account from NCO?

I did research via the internet on NCO & did see a lot of bad press. Then when the name LVNV popped up, again not too good sounding. I worry about if I pay & I worry about if I don't pay.

It is frustrating for we are trying to take care of our credit, hence getting the reports & now this bit. It worries me to what else may come about.

That is good too, you could send them a letter telling them to take a flying leap basically and forbid them from -any- contact with you in regards to this matter ( a CD letter is a cease & desist letter). If they actually tried to sue you, well, you could get it dismissed easily since it is so far beyond SOL, its even beyond the reporting period for the credit reporting agencies.

If they call you simply tell them that you have no idea what they are talking about and to send you a complete statement for this alleged account and that they can expect a letter from you shortly, or you could cheerfully tell them that you are sending them a letter to stop all further contact with you. You can go either route.

CD = Cease and Desist which is basically telling a company to end all communication with you. At that point the only way you can be contacted is via a summons issued by your local government. They can also sell the debt to a different company and that new company is not bound by the old CD letter. LVNV is notorious for just passing it around to their subs though to get around a CD letter plus they violate the fdcpa and the FCRA a lot. That is why I suggested that you CD LVNV directly plus the sub. I think you should also pull all 3 CRs and verify that this is not showing up. If it is showing up then they are violating the FCRA each time it shows up.

I truly do thank everyone for trying to help me understand & fix this situation . . . . ~ Thank You ~

Forgive my ignorance or fear that this could turn bad. When they called me, I answered figuring addressing this was the best option now I am not so sure.

For peace of mind this is what I am considering doing, please let me know if this sounds correct or not:

I am going to send NCO ( & should I do LVNV as well? ) a ceritified letter of vertification/validation, requesting statements from this account to prove that it is mine. Should I put a time frame I am expecting to receive these copies in the letter?

I figure this may help me to narrow down if I did indeed pay it or not. As well it gives me a bit of time to get an updated copies of our credit reports ( we already did the free one for the year so I need to pay for the next batch ) so I can confirm that this debt is not on our credit, even listed in the collections section.

Then as I wait for them to reply I figure I will compose two letters: 1) Agreement Letter of Deletion that they will need to agree to before I make payments & 2) Lack of Verification/Validation Letter in case they do not send the information back that I requested.

Does this sound proper? Will this help assure that they can not damage my credit anymore?
