A lawyer for Portfolio Recovery is threatening to sue me for a debt that is past the sol. Should I reply to him that the debt is past the sol or just wait for him to sue me to bring it up in court? I'm hoping to scare him away from suing me with a sol letter but I am afraid that they may reage the debt if I show my cards early. Any suggetions?

If the debt is past SOL, you should never pay it off because if you pay off the debt, the SOL clock will restart and you may become liable to pay off the entire debt. If they sue you to the court, ask for debt validation in the court itself. If they cannot provide you with proper debt validation, they cannot bring judgment against you to recover the debt.

Hi jane0659,

Welcome to the Community.

Send them a Debt Validation letter, Certified Mail, Return Receipt Requested, as soon as possible (today is best). Look them up on RipOffReport, there's quite a few complaints filed there. See the following:

They are bottom feeders, careful with them. As far as I know, they can't re-age the debt unless you make a payment on it.

Keep us updated. Hope this helps.
