NES lawsuit?

has anyone successfully filed and/or won a private suit against NES? i want to file one, but i don't understand how i'd win if most of my proof is just hearsay since i didn't record any of their conversations.

talk to me about what they did.....

I am in the process right now of getting everything together that I need, and then we are going to file one against National Enterprise Systems. By we, I mean myself and my wife, it isnt a class action suit or anything.

They started calling us for a discover card, but we never had one. It took them precisely 6 days to violate the fdcpa at least 9 different ways. So, when I got one of the "supervisors" on the phone(Carol, I believe), I proceeded to read down the list of violations that her collectors on the phones were committing. I read off each thing they did, and then told her what part of the FDCPA it violated. Then I told her that I would be happy to send her copies of the recorded phone calls....she actually asked me if I was an attorney because I know the law. I am not, but I told her that it didnt matter because I wont need one to fill my pockets with their FDCPA violation money, payable in my direction. I actually had FUN on that collection phone call!

For some odd unexplainable reason, they havent called back again, I wonder why....

They told me that my wife was going to be charged with two crimes. They claimed that the client has the authority to make that decision, and that it was out of their hands unless we could pay in full what they claimed we owed on the spot. Then they told us two different amounts in two phone calls, and when I verified with Carol that they only had one account that they claimed belonged to my wife, I knew that someone was trying to screw us. They were supposed to send the consumer rights disclosure within five days of initial call, they didnt do that. They then claimed after the third phone call that she was getting sued, that a lawsuit was just filed and we could head it off by paying in full. No lawsuit was filed....

These people are completely out of their mind to do business like that.

So, what did they pull on you?
