I was served papers on capitalOnes behalf basically threatening to sue well the debt is only $918. and some odd change not too bad compared to others ive read...i have paid off 3 other creditors in the past year capt one is my last outstanding the other creditors settled and my question was am i able to request settlement after ive been served with court papers..or by not contacting them within the thirty days have i agreed the amount is correct therefore having to pay said amount??


As you have received the court papers, so you need to answer the summons first. Next, contact Capital One and explain to them that you want to settle the debt out of court. Make a reasonable settlement offer to them. If they accept the offer, then draw up a contract with them on the condition that they will withdraw the case. After that pay the settlement amount on the scheduled date and request them to update the account status on your credit report.
