We are in the very early stages of debt settlement. We just stopped paying CCs at the first of the month to save money for settlement. Discover is already calling me at home, at work (I did tell them to stop or I'd get fired), and has recently even called my parents' house (and were very rude to them). I guess I have a couple of questions about this whole process:
- Is Discover card the most rude and aggressive? If not, what other companies can I expect this behavior from? (We have most of the major cards)
- I've seen other people's posts on here that have said they even contacted their neighbors: is this the rule or the exception?
- Are they breaking any rules by contacting me through a third party given the fact they've already successfully contacted me at my home number and address?
Thanks!

The Fair Debt Collection Practices Act is the set of rules debt collectors must follow. Discover is the OC and not considered a DC. They still are not allowed to contact you at work or your neighbors. Keep a record of these violations if they don't stop and you might be able to file a suit against them.

Turn the ringer off on your phone and talk to them when you choose, they will call everyday. If you are planning to settle within the 180 day period just talk to them about once a month.

if discover has it, than you are really in the early stages :) if they sell it to a collector, they would have to abide by the FDCPA. than you can send debt validation letters as well as a C & D.
do they still call you at work? most OC stop when you request them not to even though they do not legally have to.
