Date: Sat, 01/02/2010 - 12:05
Account Opened : 08-20-2003

According to the Fair Debt Collections Practices Act (fdcpa), this account will be out of status after 08-21-10 base on the 7 years status of limitation.
The question is can LVNV make any claim on my credit repor before and after 08-10-2010 ?
Thank very much in advance

Listen to me and do this today. make a copy of your credit report and any information on LVNV funding llc. Look up Larry P Smith and Associates on line. Can be found under 1. If he is licensed in your state, follow his form and send him the information if you believe they have violated the FDCPA or FCRA. I delt with LVNV and had a favorable outcome. If you need help send me a message with the state you live in.

Also you have left out information about this debt. The date on your credit report may have been when they (LVNV) got the account. Even if they didn't; without another credit report you won't know if they reaged the account. Second have you sent them a validation letter yet? Second have they called you yet? If so did you keep the number from caller id? You have to take a few steps before you contact an attorney, which I did not stress in the first email. You need to send them a validation of debt and cease communication letter, certified mail ONLY!!! You also need to dispuite that account with the credit bureaus. I have found if its on your experian, they are fastest to dispuite online. Once you get the response back about about your dispuite, look for the phrase "account dispuited by consumer" on your credit report. IF they do not put that on your credit report you have a voilation of the FCRA. You will want to keep a coy of the original credit report and they new showing this. Then only give them 30 days to propely validate the debt. If they do not you have a second violation. What you are wanting to do is keep a paper trail. Do not talk to them unless they call you and say "I dispuite the debt and will look at a paper statment if you send it." Hang up and do not make contact with them again. You may however be polite at first and ask the reps name who calls you. WRITE IT ALL DOWN.
