Credit Collection = sue me????? Help!

Just signing up here because I am faced with an impossible situation. I have been contacted by a Collection agency, URS united recovery systems (?), on behalf of Capital One. They called me at 8AM last Saturday morning with a demand to pay my account balance off in full by noon. After telling them that I had nowhere to come up with 3900.00 at all, they told me that it would be referred for legal action by Capital One. I was able to finally make a "good faith payment" of 300.00 to the account, and they scheduled a final check to come out (which can be deleted) for the remainder of the balance. I know that I fell back on this, but now I have just graduated college and have a steady income and they still refuse to set up a payment plan to get this paid off. What are my options, and what are my rights? I really can't go to court for this! Does my good faith payment of 300.00 help my case? I am willing to pay - I even stated that I was willing to set up 12 post dated checks for each month for 300-400.00 each, but they will not accept that either.

I would call Capital One first and find out if they still have the account or if a junk buyer has bought your debt. I am dealing with Capital One now and have been sued. I rec'd a civil summons on two credit cards and now dealing with the attorney that was hired in my state by them. They were not large amounts starting out, but they have tacked on some outrageous fees that I think should be against the law.

I am not sure what to do - I want to pay off the debt, but will not be able to afford other fees etc...what are outrageous fees, just in case this gets that far? what should I expect?

At the time I was intimidated into doing so and did not see any other choice - I am afraid I have gotten myself in too deep with them, is it too late to send them a DV letter? They are still again today threatening legal action. They said they did not buy the account, but nobody at Capital One will talk to me about it and they forward the calls to URS instead. How can this be?
