Ok so let me try and explain this the best I can. First of all I will admit I am stupid and ignored this problem way too long. I kept on getting notices from lvnv funding llc about something I couldn't pay back due to loss of a job and now I got papers in the mail last week about going to court.

I had gotten notices in the past about them wanting to work with me and I was afraid of contacting them and just thought it would go away. Well it did for a few months until I got the court papers in the mail.

Is there a way of contacting them to see if I can work out a payment plan with them? I don't want to go to court, would rather just settle this right now and pay for my stupidity in the past. I can't afford the $2,133.66 I owe them. I need to set up a payment plan with them. I live paycheck to paycheck and don't have 2 grand sitting around to pay them. Are most agencies willing to workout a payment plan with someone? I just need to find the contact info so I can get a hold of someone to talk to this about. I am worried and have had troubles sleeping because every night I go to bed thinking about this court case and not wanting to go through with it. :roll:

If you were served with court papers, you will probably have to contact the attorney who signed the petition to work something out. Most companies that already have counsel will not want to talk to you directly because their attorney is getting paid on a contingent fee basis.

First of all, you're NOT an idiot. You came to the 'right' place........everyone, on this forum, is going through the same thing you are. ALOT of companies are willing to make payment arrangements with people.....you should call them and see what you can do. Remember...........they can't read your mind ( too many think that). Companies don't know what you're going through unless you tell them. I think that would be the 'first step'. What do YOU think?

Yes I am going to contact them, I just need to find the correct contact information. I looked at their website but could not find such information. I looked at the BBB website and found 3 different numbers and addresses. I guess its time to do the process of elimination :evil:

Don't let this company bully you. I'm going to tell you how to smack them down (possibly before trial begins) just because of how they treat people and the fact that they break the law and perjure themselves all the time.

First, get an attorney. Make sure the complaint gets answered. Have your attorney motion to show cause during discovery by asking for validation of debt, this may consist of:


Now they are probably going to produce affidavits testifying to the validity of the debt, probably signed by either a Sue Argentieri or Allison B. Moon. These people as far has been researched do not exist, or merely cannot be located. If they try to pull the affidavit trick make sure your legal council objects to the affidavits as they are hearsay without the person signing them present to testify to their authenticity/accuracy.

Finally, when they fail to present debt validation per discovery request, have your council motion for dismissal with prejudice.

Hi, 'Confused'. i live in PA now, but...was born and raised in San Diego. YEP..been a Charger fan since I was concieved!!LOL Next week..the Colts and the Bolts. OMG!! LOL I was GLUED to the TV set last nite!! Well..I hope the advice, I gave you helped alittle, to help you make a decision.

Confused...the advice already given is very good. Especially from JCEMT. Do try to get some legal help..if you can't afford a lawyer..try legal aid. Court is not as bad as you may think..most judges will listen to both sides before rendering a decision. I was an "idiot too" and was taken to court..it worked out better than I thought.
