Can anyone tell me what it means to receive a 1099-C on a home that has been forclosed on? I am sure it is good right? I had my home (of 11 years) forclosed on (painful memory) and the mortgage company sent me a 1099-C for the forgiven balance on the mortgage. I filed it with my taxes last year. I see that the mortage company is still making (this year) inquiries regularly on my credit report (the ones that are viewed only by you kind). Why? The entry on the credit report still shows that I have a balance of $143,000 and past due balance...the house has been long ago sold through forclosure, I don't understand. Is something wrong here?


If you have already filled up 1099C form and paid taxes on the exempted amount, then as far as I know you are no more liable to pay off the debt, because the creditor has also got tax exemption due to loss incurred as a result of forgiving the debt.
Since you have already paid tax on the amount exempted by the creditor, you can send a letter to the creditor and ask them to stop pulling out your credit report. You can also tell them that you will complain against them to the State Banking Commission and the FTC if they do not stop making hard inquiry in your report.
