Rio Resources threatening wage garnishment

I had a loan with rio resources which defaulted due to my account being frozen. Instead of working with me they are calling my work and threatening to garnish my wages. Can they do that when I am single with three kids


Lies, lies, lies. That is standard statements from Rio. You will find so many people hear just LOVE Rio and their kind, legal approach to collection.

You may want to look into sending them letters telling them to cease all phone calls and contact you via mail only. You can find copies of the letters here:

Wage garnishment cannot be done without court orders. And for doing this, they will have to file a case in the court and prove that you were regularly defaulting in your payments. Have you checked your bank statements and the pdl laws of your state? You need to prepare your defense first.

First find out how much money have you paid so far and the laws followed in your state. You will know the latest standing of your account and then move from there.

I had a loan with these guys back in 2005. I didn't pay anything on it for a while so they sent it out to Ellis Crosby & Associates. I paid them $270.00 last year and they never posted it to them. Anyway, they sent it out to a new CA and they called for about 3 months everyday. I spoke with a manager @ Rio Resources and he said that if I would fax him the moneygram receipts, that he would clear it out of the system.
