Talk to me about National Enterprise Systems-anyone dealt??

Ok, got a phone call today....man, I cant WAIT to sue these morons!!

A "Mrs. Jones" called for my wife, who was not available. So, I tell her I am the husband, how can I help you? She proceeds to tell me that my wife has had two complaints filed against her by their client Citibank, and that my wife is facing criminal charges for bank theft and intent to defraud a financial institution!

Thank GOD I hit the record button.....hahaha

Ok, first off, I dont even know about a citibank account, we havent gotten anything in the mail from them and this was the first contact. She informs me that my wife is about to get a subpoena to appear in court(I should have told her its called a SUMMONS when you get sued, not a subpoena....like I said, morons). I ask her why she's violating federal law by claiming that this is a criminal matter when it's clearly a civil one. Her response is this--and no, I am not kidding--

"but you said you are her husband, is that right? So I didnt break any law, under the law I am allowed to discuss this matter with her husband"

Can ANYONE please tell me what in the unholy crimson hell that actually has to do with how I told her she broke the law?!?

So, I ask her to identify herself--she says she has an ID number but she doesnt have to give me squat, so I cannot identify who she is. But no matter....this contact provided one solid and one possible fdcpa violation....

1--claiming criminal charges are filed
2--saying they are suing me right now(if they dont do it they screwed up again)

I told my wife, and we are going to wait the five days to see if they send out the required disclosure notice. I bet they dont do it. The call lasted a few minutes and she never even told me a dollar amount that is allegedly owed! So, we have no citibank accounts and no info on this one except for FDCPA violations. MAN, this is gonna be fun!!

Has anyone dealt with National Enterprise Systems before? I would like to know what else I am in store for...

Tell her it's OK if she doesn't want to identify herself, the court can ID her from her voiceprint on your tape.

the only thing that was stated was done by recorded voice at the start of the call--saying that this call may be recorded or monitored. There was nothing else said--this idiot didnt even tell me the name of the actual credit card company(citibank issues cards for many different retailers, so I dont know anything about the account), and she didnt even give me a dollar amount--all she said was that we owed them seven hundred dollars.

OK, check this--I just got a second call from the same people. Press record, then dial the number back. It was some guy this time, telling me that my wife is getting sued in our local small claims court for the balance of $548.00 from Citibank. The same company. The same info about Citibank. Two different amounts. And still I have nothing that identifies this account!

Oh, and can someone please tell me why debt collectors are so friggin ignorant? Anytime I mention recording the call, they flip out and say that its illegal for me to do that without their permission. Why the hell cant these people read the law?? Oh well, he started the call the same way, saying that Citibank had filed charges against my wife. I said, "hang on, I want to clarify this....are you talking about criminal charges?" He said, "Thats right, she's going to have to go to court." Later he contradicted this and claimed he never said anything about criminal charges, and thats when I said "thats ok, the tape recorder picked up what you really said and I am sure the judge will have something to say about it...." Then he flipped out, yelling that I had no business recording because he didnt say I could.

For those who do not know, there is no federal law that requires an individual to get all parties permission to record a call. Federal law allows you to record a call as long as one person who is part of the call gives consent. The state laws are different but my state is a one party state. So I was well within both federal and state law by recording the call.

Still would like to hear from anyone who has had to deal with these morons. I know someone has had to because of the info on bud hibbs....they have had over 100 lawsuits in federal court alone since 2002. I cant wait to see what information comes in the mail. Or, more accurately, what doesnt come that is supposed to....

I recently worked at this horrible place. National Enterprise Systems is the collection agency from hell. It's the devil's worst nightmare. Employees are trained to collect according to the Fair Debt Collections Practices Act but once on the floor in their respective departments collectors are told to forget everything they learned.

My supervisor, Bryan Howard under the alias of Paul Stevens, regularly provided a second voice to collectors having trouble closing collections. This idiot would identify himself to callers as a federal agent, an NES attorney, etc., anything to try to scare the debtor into paying. He would actually tell debtors and their spouses that a lawsuit had been filed and if the account is not paid by postdated check by a certain time that day a deputy of the court was coming to serve the debtor on his job. I witness this on a daily basis all day long. B. Howard is neither a federal agent, attorney nor any of the other things he claims to be and NES don't sue debtors. All are clear violations of the Fair Debt Collections Practices Act.

Debtors are talked to as if they're inhuman. Even when the debtor is not home the person taking the message is treated like dirt. I will never forgot my supervisor shouting at an 81 year old African-American woman for not getting a pen and paper to take the message. "I DON'T CARE IF YOU ARE 81 YEARS OLD HE SCREAMED AT THE WOMAN." I've witness collectors hollering at kids "GO GET YOUR FATHER."

You are not supposed to talk to spouses????????in certain states--about their significant others???????? debt unless given permission by the spouse to do so. This rule is ignored at NES. In fact when I left training I put the document about the spouse rule on my cubicle wall to reference only to have it snatched and trashed by Bryan Howard who said I wouldn????????t need it.

The owners Ernest Pollack, his wife, and two sons: Scott and pie-faced Chris are well aware of what is going on. These people are hands on owners. They constantly walk the call room floors, note the individual collectors and group collection sales and hear all the violations first hand. The more a collector screams at a debtor the more they like it. People actually clap and cheer when a collector goes off on a debtor. All that concerns these greedy money grabbers is how much money they are collecting at any given time.

Payments are demanded in full although they do offer settlements that are too demanded in full. Money orders and mail-in payments are not accepted, only postdated checks over-the-phone or Western Union Transfers for Citi Bank accounts. Some other creditors do allow NES to also take payment by credit card. For the postdated checks debtors are asked to give their accounting and routing numbers. NES, the scumbags they are, attempts to take the money out before the postdate. Nice company huh!

Collectors and supervisors once provided with bank info by the debtor call banks automated customer service numbers to obtain how much money they have in their accounts. We have their social security numbers so getting info this way is like taking candy from a baby. Some banks have safeguards against this and required you talk to a live person. They also work this wickedness on debtors???????? credit card accounts or the credit card accounts of the debtors???????? spouse, mother, father, etc. I remember one collector on the phone with a debtor saying ???????Your Mother Has $7,000 On Her Card She Can Use;??????? She Can Pay This Debt For You!???????

If anyone needs someone who's "been there" in any of their legal actions against this despicable company I????????m your guy.

I am replying to the statement made above from, Drew22. I was wanting to talk to you, if I could personally, via email or telephone. I am have to deal with this company right now. And for the last 3 days, I have had to deal with the exact same problems that you have described in your post. Drew22, if you read this please email at edited for your protection - ND. I would appreciate any info that you could give me to defend myself against these guys. Thank you

Daniel...the poster you are referring to made that post in 05/08. I doubt very seriously that he will see this - ND

I recevied multiple calls from the "National Enterprise Systems". The number that keeps coming up on caller ID is 305-851-7464. They began harassing from the beginning of the phone conversation stating that I owed Bank of America $4,000+ in credit debt that has not been paid for years. I stated it was impossible as I have absolutely no debt on my credit cards. They then stated that I was not telling the truth and that they will file charges. They started to ask for personal information such as my social security ID. I refused to give personal information on the phone, as I was not the one who called them (such as a bank for verification). The representative dropped the call immediately. I called back the number and a second individual answered. He acted concerned that I was treated inappropriately, but when I requested to speak to his supervisor and requested his ID badge number, he did the same and hung up the call.

National Enterprise Systems is a scam. Unfortunately, there is no way for us as consumers to appropriately file a complaint and close them down. It's unfortunate that life these days revolves around scams...

i used to work for nes in the citi bank department and we used to get sued all the time i walked away from that job but the top collector were making in the $100,000 a year range due to these tactics.. i was too nice of a guy to go along with that crap so i walked out lol

I have a student loan with them and they want to take money out of my account. Has anyone had a call about a student loan? I would like to start paying my loan off, but I don't want it to go to the wrong people.

I dealt with national enterprise systems before. I had a Citibank account, and they called to attempt to collect the debt. I worked with a Matt Hoffman, he told me that unless this debt was resolved the creditor would take legal action. I agreed to pay them 3 installments over 3 months via western union. According to Mr. Roffman this was the only way for the debt to be settled. Once I fulfilled this obligation I never received confirmation of such. So, here it is a little more than a year later I am receiving calls from yet another law firm talking e,exactly the way this nes is talking trying to collect the same debt????????????
