I am new to your site, but have found it very informative. I too have been contacted by CRSI. I told the individual that I have an attorney and have asked that they contact him. I did not have all the information in front of me, but gave them his name. They instead contacted my office again, telling the receptionist that they were filing a complaint against me, and then proceeded to get the physical address of my office. In fact, they have contacted my office twice since talking with them only yesterday. They then contacted I presume my references that I had provided on my loan application, one being my father. He said that they were very rude, asking for information about me and were very persistant. I called the company back and asked that the cease calling my office and my references and asked that they contact my attorney. The individual inquired whether or not the attorney was going to pay my outstanding debt. I asked her to contact him and that I will not talk with her anymore. She became very rude, and I ended up hanging up on her. I am worried that they will continue to call my work or try to get through to my boss - which would not be a good thing. They have asked for her, but the Receptionist is smarter than that. Furthermore, I believe my attorney may be on vacation due to the holidays. I am really new to this collection thing, and I was wondering if anyone had any advice they could offer.

Welcome to the forums.

In most of the cases, collection agencies use unfair and illegal ways while recovering the debt from the consumers. If you have informed them to stop contacting you, they should follow your request. But, in your case, they are not doing it. Thus, in this situation, you need to send a legal cease and desist letter so that they stop contacting you further. A cease and desist letter is a very powerful and legal weapon that helps to get rid of the illegal and abusive collection calls. Mention in your letter that you refuse to be contacted at your place of work or by phone and the future communication should be done with your attorney. Once they have received your letter, they are required to stop calling you. Otherwise, you can file charges against them with the help of your attorney. Send your letter certified with return receipt requested. You will have proof of all the actions taken against them.

Any collection agency is required to give you the debt validation details before they attempt to collect money from you. You should get the details in writing within 5 days after they have placed the call. If they have not sent you anything in writing, send a debt validation letter to their mailing address. They are required to prove that your account is with them in legitimate terms. Also, the name of the creditor along with the account details will be mentioned in the paper. It is very important to do your communication in writing. Written correspondence gives you the legal proof of all your actions taken while dealing with the company. Do keep us updated on this matter. I have been contacted by crsi. I can only tell you that i have never experienced such rudeness and downright nastiness in my life. the person (denise gooding) went as far as calling my home and speaking to my mother (78 yrs old) who had just come home from the hospital (problems with her heart) and she was told that I had a bench warrant - which was entirely untrue. can i sue these people. and on top of that i cannot find out any kind of address and i tried to make arrangements and they kept trying to get me to say i refuse which i didn't. please help me with these people

Hi Gail,

There are many powerful weapons in the federal laws that can save you from the harassments of the collection agencies. Although, the CAs are not allowed to violate the fdcpa laws, but they are using the scare tactics without any fear. Make your legal side stronger by sending a cease and desist letter, debt validation letter, recording the phone calls secretly if allowed in your state. If the state laws insist you in taking the permission from the other party, make sure that you have done this.

After covering all these legal aspects, the collector should stop contacting you without any legitimate purpose. If they still do so, it will result violation of the FDCPA laws and you are in charge of taking legal actions against them. Consult an attorney who specializes in the lawsuits of FDCPA and FCRA violations.

I deal with these idiots at least twice a month on a debt my mom owes. They have called and stated she has been arrested and I have to pay them the amount owed on her debt, told me that they have a bench warrant for her arrest and the latest one is accusing me of being my mom. I ask how can i be her when we live 1200 miles apart? They state I have 24 hours to corospond with her and I tell them the conversation is being recorded and a police file will be updated on their continued harassment for a debt my mom owes. When I call her and let her know, she states that they left the same message on her machine. They have refused debt validation and are ignoring both cease & desist letters sent by both of us.

File a legal case against this collection agency on charges of not validating the debt and violating the laws of C&D letter.

The collection agency must respond to you within 30 days with the details of the debt. If they have not replied within the timeframe, consult an attorney with the proof of your green copy of the validation letter and the C&D letter. Your attorney will guide you further and send a hearing date to the CA. Legal actions will force them to behave properly with you.

I WAS SET UP ON A PAYMENT PLAN WITH THEM AND NOTICE THE PAYMENT WAS NOT TAKEN FOR THE 15TH OF JULY. I CONTACTED THEM AND REQUEST TO SPEAK WITH THE MANAGER ERIC MADRANO. MR. HARRIS STATED HE COULD NOT COME TO THE PHONE AND WHAT WAS THE PROBLEM. I EXPLAINED TO HIM WHAT I WAS CALLING FOR HE STATED THEY NO LONGER COLLECT FOR PLATIUM CAPITAL, SO I ASK FOR THE NUMBER TO CONTACT THEM AND HE STATED HE DIDN'T HAVE AND I VCOULD GOOGLE IT AND FIND IT. I ATTEMPT TO GOOGLE THE INFORMATION AND NO SUCH COMPANY WAS THERE. I CONTACTED THE COMPANY BACK AND LET THEM KNOW I STILL NEED HELP WITH CONTACTING THE COMPANY MR HARRISS GOT BACK ON THE PHONE AND STATED I TOLD YOU WE CAN'T HELP YOU. SINCE WE DON'T DO THIER WORK THEY HAVE NO WAY OF CONTACTING THE CO. I THINK THERE IS SOMETHING WRONG WITH THIS PICTURE. I WAS PAYING THEM 87% INT. ON A BILL THAT DIDN'T MAKE ANY SINCE. I WAS TOLD NOT TO WORRY ABOUT THE BALANCE SINCE I HAD ALREAD PAID 3410.00 WHICH ONLY 2200 WAS THE BILL CHARGES. I CONTACTED AMERICAN DEBT AND REQUESTED THE NUMBER FROM THEM AND WAS GIVEN CRIS NUMBER AS THE CREDITOR RELATED TO PLATINUM CAPITOL.
