i got a call last night from bass &associates at 8pm last night.her name is kelly young and the # was 877-281-2224 ext 318 she said i owed 565.00 and and had 2 hrs to pay it or the file would be downloaded and i would be arrested as soon as possible. i did do the internet payday loans a year ago i told her i was in bankruptcy and gave her the # she said the bank wants their money.i told her i was paying the loans back but the bank closed my checking acct because my acct was negative so much.she gave me money gramm code # and all info to wire the money to jacksonville fl i'm waiting on my atty to call me.please put my mind at rest i don't have the 565 i;m still in bankruptcy,and my house is in foreclosure.please respond as soon as possible. i'm about to have a nervous breakdown just over my other situations james davis columbia, sc


Welcome to the forum, James! This Kelly Young is making illegal threats, so rest assured that you're not going to jail. Bass & Associates have used that line with a lot of people to scare them into paying right away. You are in bankruptcy, so let your attorney deal with it. I'm sure you have enough on your plate just handling the bankruptcy and foreclosure. Who was the payday loan with?

You can send a Cease & Desist letter to Bass & Associates requesting that they no longer contact you by telephone and that they should put all future communications to you in writing. If they contact you after you have proof that they received your letter, they are in violation of the fdcpa laws and you can file a suit against them. Send your letter via certified mail/return receipt requested. Here's a link to a template that you can personalize.

There is a thread on Bass & Associates and people say that they are violating many of the federal and state laws. What's wrong with this company? You can view this link and read the various posts of people called by them.

James, it sounds that this debt was not included when you filed for bankruptcy, did you? And they are a collection agency; did they validate the debt to you in writing giving proper info? They need to prove their authorization to collect on this.
