If my posts have the tone of arrogance or someone who sounds irritable, please forgive me. Receiving 20 to 30 calls a day is bound to have a negative effect on one’s state of mind. As I have said in earlier posts. My phone is set to VIBE so I do not have to hear the collectors constant nagging. What bothers me more are the calls I am missing because my phone is set to vibe. (Some people do not like to leave messages) I would like to respond to a previous post that was posted on this board.
“Unregistered Replied on 06-23-2010, 10:41 PM
I was with this company and they are such a rip-off almost got taken to court by one of my creditors and ended up settling my debt my self, some creditors could care less about this company, they took months of my money and were no help, I am trying to get my money back. This company sucks. “
I am not defending the company. I would just like to explain what is going on here as I see it.
1. I was with this company and they are such a rip-off
I know exactly how this person feels, because I’ve been there. If you are turning over your difficulties for someone to solve for you, there has to be a reasonable level of trust, patience and cooperation.
2. Almost got taken to court by one of my creditors
Unfortunately, I know how he feels here too. And, I have to say IT SUCKS to feel worry!

There are a few options that a creditor has in order to recover their losses.

 • Refer your account to an attorney for legal action. If legal action is filed against you, we may be granted awards such as wage garnishment or lien as permitted by law.
 • Place your account with a third party collection agency. We will grant permission to a third party collection agency to collect and liquidate your account on our behalf.
 • Sell your account to a thircd party debt buyer. Even after your account is charged off as a bad debt, a third party will continue to contact you to collect your balance and liquidate your account.
 • Retain your account for continued collection efforts. After your account has been charged off as a bad debt, you are still responsible for paying back the balance.
The above “A” through “D” is from a creditor’s letter. Just last week letter “A” happened to me. Most Multi-Billion dollar Corporations have their own legal department and will pursue you. It is not cost effective for them; I would think that they would rather settle than go through the court process. The other day I received a letter telling me that my debt has been turned over to their legal department. I was sent settlement letters from this company of 50% and 58%. If I am given a summons, I will show those settlement letters to the judge, tell him/her I have no money and would like time to payback the debt at 58% as their letter states that that is what they were willing to settle for. I can’t tell you what the outcome is, because I haven’t been there yet, and I hope I don’t ever get to that next step of having to see a judge!
3. They took months of my money and were no help, I am trying to get my money back. This company sucks.
Fast Track can better explain their program than I. You need to build up enough money in a trust fund for settlement purposes. This usually takes a few months. For me it took 5 months before my first account was settled. Two of the 10 accounts that I am seeking help in settling, have been settled. The first was HSN at 50% and JCP just settled at 75%. I am on a two year program, and I hate being in this situation, but just as there is a beginning, there is an end, and this uncomfortable chapter will eventually come to a close…
A few posters emailed me and asked me for more information. I am always glad to help if I can. If you would like to email me,
My email address: lcervantes03@comcast.net (small L in front of the C).This is not an easy process. It is filled with worry and constant calls from creditors. I hate being in this situation, and the situation that I am in was totally unnecessary. The unwillingness of two creditors to be understanding and sympathetic to my unfortunate turn of events caused me to be angry and defiant to their system of credit. I know that it is impossible to make a multi-billion dollar company blink. It just goes to show you what the true philosophy these company’s abide by. During the holidays they paint a pretty picture and offer you the world, but woe unto you who is late on payment after the holidays. There will be weeping and gnashing of teeth!
If you have been following, these are the posts that I have posted on this message board: Sub 21, sub 24, sub 25, sub 27. sub 28, and sub 30. Again, as soon as one of my accounts is settled, I will post it.
Here is an update of my settlements:
I began this settlement process August 16, 2010. I have deposited on a monthly basis 582.02. February makes it six months that I have been with Fast Track, for a total of 3,492.12 deposited into a Trust Fund for the purpose of settling debts. Four months into the program my first debt was settled. It was HSN, which was one of my smaller debts, (I have 10 credit cards that I am having Fast Track negotiate settlements for. HSN – Amount owed 741.59: Amount settled for: - 370.80 which equals a 50% Settlement. My second settlement was JCP credit card. JCP – Amount owed 1956.08: Amount settled for. 489.02 which equals a 75% settlement.
Good luck you all! ;)

I sent him a warning regarding this issue but have asked him to repost it since it discusses personal experience with companies.
