First be confirmed that you never had a Radio Shack credit card.
First be confirmed that you never had a Radio Shack credit card. If you are 100% sure about not having the card, they cannot do anything against you. If they hit on your credit copy, it will be a fraudulent reporting and you will get a case against them. They are trying to scare so that you pay them without asking for anything. You have every right to ask for the debt in writing. Make them validate according to the FDCPA laws. You have to send one DV letter if they don't send you anything in your mail. Send your letter CMRRR so that you have a proof of your taking care of the matter and not showing any avoidance. If they are doing a fraudulent activity, they will leave you after sometime.
Keep a check on your credit report on this Asset Acceptance. Their reporting should be genuine by all means, if they ever hit. Get a lawyer and sue them in case they do fraudulent activities to hurt your credit.
As Howard stated if you are 100% sure you never had that account
As Howard stated if you are 100% sure you never had that account or if you had account and it is 100% out of statute for reporting or court action,I would do this:
1. Send full cease and desist.
2. Keep a very close eye on credit reports as these guys do not like to play fair.
3. If they should be dumb enough to sue you, ensure you respond to any and all court paperwork or meetings so they cannot get default judgement.
4. If court happens, your defense is either this is not my account or this is a time barred claim.
5. Should it procede to court, hire an attorney.
