Anyone ever deal with Nationwide Cash for a payday loan? I faxed them the letter asking for them to mark my account paid in full, as I have paid back more than twice the original loan amount. They immediately called me back, and I was connected to a supervisor named Lynn who immediately became very rude and defensive with me. Supposedly, she is a "paralegal" and knows the law. They do not have to follow Arkansas state law, only New Mexico state law. I even read her word for word the Unconscionable Trade Practice verbage issued by the New Mexico Attorney General's office, and her reply was still that they don't have to follow Arkansas state law. She even asked me where I got my law degree, and informed me that I needed to know what I was talking about before I contacted them. Any idea on how to handle this from this point? Needless to say, all she has done now is made me very angry and more determined not to pay them any more money. Thanks, sorry this is so long!

My husband took out a payday loan In June of 2006. THEY found out MY Bank account info and ILLEGALLY took the funds in 11 different transactions for twice the amount of the loan out of MY bank account. I am now having all the funds investigated with MY bank because I OWE THEM NOTHING. I even called and spoke to the Supervisor there Mr. Schofield, who told me because he is my husband too bad they will not refund me my money back into My bank account. So Now I am reporting them to the BBB, and having my bank get the money back for me. I dont understand how someone can take funds from someones bank account without their consent and for someone else's debts. If anyone out there has any idea what Else I should do, PLEASE TELL ME!!!

If I were you I would also report them to the FTC and file a complaint with your Attorney's General office. These illegal Payday loan tactics are getting way out of hand and the more we complain maybe the faster they will do something to control this problem.
Sorry you had to go through this and I hope your bank works fast on getting your money back.

i just reported to ftc, they got my account number from another application and just started debiting it without asking for permission and while refusing payment by western union and said they wont take mail, so they will just take payments ach. I told them they were not authorized and they said yes they are and they will continue. I taped it. heheh. i did owe them and was going to pay by mail, but they hit the account with the ach. can i do anything since they got the account number from an application and just debited it even though not authorized?

Wes - do you have the info on the phone call recording law in your state? Its illegal in some states, unless you inform the caller that you are taping.

I would go to your bank and dispute the ACH on the basis that it was not authorized.

the law here states that only one person must have knowledge that the call is being recorder and as well i stated that the call would be recorded for future refence. So i was nice and even let him know.

Now as i understand the zippo case, even though i made a payday loan through the internet they knew i was a resident of oklahoma and that they must follow the laws of this state since thats where i reside and the transaction took place i guess, they sent the money to a bank here and take the money from a bank and and i live here..can someone clarify for me

my childs social security goes to my account that i opened last year after a neighbor assumed my idenity for drugs he got pdl,s and forged several thousand in checks ,he is n jail now but ambassador collections staarted unauthorized debiting my account what can i do im already overdrawn 366.00 as of 2 days ago i dont know how ill pay my bills

You need to close this account and open a new one while you can. Because it is after the 10th of the month, you won't be able to stop the direct deposit of your son's social security check. But before you close the account put a stop payment to this company with your bank, you will pay a fee, usually the charge is the same for a bounced check. But at least you will know that they aren't going to take the money. Then you need to file a complaint with your Attorney General's office. But you should get a new bank account before the 10th of the month in April to have that social security check re-routed. I know that after the 10th of the month Social Security can't do anything for the following month.

These jerks got my new bank account information from a network I applied to recently. Since I owed them money from four years ago, they went in and debited my account for the balance due. When I called them they said they have the right to debit any account owned by me if I owe them money. They said their contract refers to this. Is this true? Can they really do this?

This company tried to initiate an ACH debit transaction on my bank account and i have never done business with them before.

The had no phone number listed. Doing a google search they had an 866 number which I called. They were no help at all and could not anwser my questions.

I presume i am a victim of fruad. What avaible legal help is there?

Please go to your bank and explain..have them put a hard hold on your account. Or close this account and open one at another bank...do you still owe them on the original loan?? You need to send them a cease and desist letter...stopping them from the debits and any further action. Look up your state laws to determine how much you actually owe and then file a complaint with your state's attorney's office and the bbb. Keep reading on this site, you will find all the info, letters, etc. you need to help you.

I have been completely sick at my stomach today because I got a call from everett today from Ambassador loans and he said that they were going to file charges on me for fruad, and that because it was across state lines it wold be federal charges, I tol him that I never applied for a loan with ambassador loans or nation wide, and that the only payday loans I have ever gotten were from Pay day ok and cash net usa, and they have both been paid off. Then he told me I did not apply directly with them but payday ok sent me to them as I was looking for a lender and they gave me the money, without me signing any thin. The I said well that sounds illeagel to me and his response was not exactly, ok what is not exactly, just a little huh! I sent my bank statement from an account I closed because I did not know where my money was going, and after a couple weeks of investigating, it was to them. The loan was for 400 and they have taken 616, and say they have not seen any payments, I sent a copy of my bank statment and never heard back from him, should I expect this to be over, and if not can I go to prision for this, and how do i STOP IT?

I have been threatend by Ambassador collections, and I do not know what to do, I did not get a loan through nationwide, or ambassador, and yet I have unknowingly paid them 616 dollars, When it came out I stupidly assumed it was to payday ok. I sent them my Bank statment because they claim that they never took any money, I dont know how to prove that I di not get a loan through them, and now they are telling me that since I live in Texas, and I closed my account I have commited fraud across state lines. They are telling me that I will be investigated, and prossicuted, and I could go to prison> What do I do I am scared I have three little kids, how do I take care of this, and can I really even fight it?

Relax and think clearly. No one is going to jail. That is something they say to sacre you and that in itself is illegal. Check with your bank or look back on your bank records...sometimes they go under different names. Contact your bank and get a list of debits made against your account., Then have the bank block them. Next look at your state pdl laws. You can file a complaint against them with your state attorney and the BBB. Stand your ground. Many here have fought and won the war agaist illegal tactics of pdls.

You can also write them a cease and desist letter telling them you will only communicate by us mail or email.

I just got a loan through this company but since never get anything in email as to balance how do we keep track? What are our rights? Does anyone have an answer as to how to pay it off? I called the 212 phone number and couldn't get through.

Did you apply for the loan on the internet?? They have a web site you can sign into to check on your account: Nationwidecash.com. You said you just took out the loan?? For how much?? Have you paid anything back as yet?? And in what state do you reside.If this is the only payday loan you have, please read on this forum for awhile before you ever think of getting any more...they are major trouble and have been heart break for many.

well, it looks like I'm in the same boat as everyone else! I received a call at work today - I could not get ahold of anyone to find out the balance due, or what was going on? Sometimes deductions would come out of my account, sometimes they would not ... occuring LOTS of bank fees! My bank account has since been closed due to multiple NSF and inability to bring account to positive balance. I was scared to death when I received the call at work saying I would be arrested, and had commited internet fraud, and would have charges pressed for "bouncing a check over state lines" ... holy cow was I scared! That brought me to the internet, and I guess I sure do thank everyone for their responses and help - I wish I would have looked into this a little more instead of being so desperate so quick!!!

I just got off the phone with Mr Fulton. I wanted to let them know I lost my job two weeks ago. I wanted to know of alternate options to pay my balance. They claim that my bank has returned all payments since June. *blink*blink* When I said I could email a copy of my internet copy of the bank statement he asked if I stopped direct deposit. I stated if I am unemployed I won't have direct deposit. And that I've applied for unemployment but not approved yet. Trying to find a solution to the problem. When I stated I am trying to find work but need an alternate way to pay he kept saying, You haven't paid yet. But then states the last payment was June 6th. I asked for a balance then. Wouldn't give me an email to send my termination letter to or any other information to try to fix this. Does anyone have an email address for these people? I can't seem to locate one, but then it might have been done on my work email.

By all this it leads me to believe that this company is a pure rip-off. I had them to take money from my bank account the other day and my wife had this reversed back to the bank account. As far as I know neither one of us did apply for a payday loan with this company. If I could have their email address so I can write them and get a copy of a contract if their is one sent to me so I may review it. I'm having problem with them too I can't log in to my account, and I called them and they told me they having problems but is every months, so I sent an e-mail to my bank telling stop paying this company until they let me log in in my accoun t to see the balance and the payment history.
