There is a new collecter out on the prowl. I took out a $200 payday loan back in 2003. I attempted to pay it back but it got so out of hand and not to mention expensive that I just have been ignoring it since 2004. So I get a call yesterday from Shelby Guy at this Taylor James and Associates outfit. He tells me that if I don't pay right then and there that criminal check writing charges would be filed against me for not paying back my payday loan.

They also through out the fact that because I used the internet at my work to get the loan that perhaps I would get fired for doing so because something about embezzling money through my company server yada yada yada.

So anyway that convinced me to send a letter of intent to pay the outstanding balance of 646.60 by today in order to prevent them from taking me to court for criminal charges. I did some research and found they really couldn't do what they said they could. Has anyone else faced a similar situation??

The payday loan company was Xpresscash (Whistler Holdings INC). I looked up Taylor James and Assoc on the BBB and the only information I could find was that they've only been in business since Nov 2005. Any feedback is apprcieated. Thanks.

This forum is heavily uploaded with information on the illegal activities done by some of the collection agencies. Among them, Ellis Crosby is the one to top in the chart. This company has been doing illegal collections and making false threats to recover money. After receiving huge consumer complaints, the Florida attorney general filed a class action lawsuit against them. As a result, this company filed for bankruptcy some time ago.

Ever since then, they have been changing names to hide their original identity. Be cautious when you are contacted by Anthony Galloway and Associates, Taylor James and some other names that are mentioned in this forum. These all companies are different names of Ellis Crosby and have been calling people with some past debts. DO NOT send Taylor James your money. They are not remitting payments back to the creditors which means you will pay them, the creditor will not get paid, and you will still owe the creditor the money. These people are CRIMINALS and are stealing from you.

Now, as a consumer, you have the legal right to know your past debt. If you owe a debt, you have to pay it. But you have to make sure that you pay it to someone with a legitimate call. Ask this company to validate your past debt so that you get the necessary details about your account. You will also know that this debt is actually purchased by them.

According to the posts in this forum, this company has never followed the laws laid down in the fdcpa and is regularly trying to scam people. Do not be victimized by them. Do not get afraid. Be aware of your rights before you make any commitment. If you are not sure what to do, consult your local consumer protection office. They will assist you in this matter.

Talk to a consultant here. He will give you free advice. You will also get some helpful tips from them because they know how to speak in their language. This discussion is free and it will be definitely of great help.

I've filed a complaint with BBB an the Fair Trade Commission on Taylor James. I will also be sending them a cease and desist letter today via certified mail. I've read all the post about Ellis Crosby on this forum and can't believe how many of the tatics were used on me the other day from this "new" collector aka EC.

Here are the lines Mr.Shelby at Taylor James gave me the other day:

1. He compared my payday loan to buying something at walmart with a check and then stopping the check.
2. He asked what my employer would have to say once they found out I used there internet to intially commit fraud.
3. He mentioned I had other outstanding payday loans and that would be used against me in court(to prove I committed fraud and had no intention of paying back the funds.

4. When he first asked me to pay the debt, he told me that I would have to make the payment via western union right away in order to keep me from being downloaded in the "system".

Mr. Shelby Guy would not fax or mail a copy proof of the debt I alledgely owed, when I asked if I would get a reciept for my payment he said sure, but somehow I think that was not true. I am soo glad that I did not make payment to these crooks.

I think we should keep track of these Ellis Crosby fakes and file complaint after complaint until they go away.

Ben just to let you know i had read this site after my call from Taylor James, I blew it off because of all the negative feedback that I had read, let me explain the possition I am in now. I had taken out a loan and had not payed it back, I decided to not pay Taylor James even though they offered payments and even where willing to settle for less than the amount that the client had originally stated. They did let me know that if I didn't pay that it would be forwarded to an attorney. Last week I received a letter from the attorney, just as they stated. I then called the original creditor, something I suggest everyone to do, they stated that they do work with Taylor James and the attorney which had contacted me. I am not trying to work with the attorney who is not willing to set up a payment plan or take a settlement.
Please do your homework because i didn't and wish that i would have just worked with them.

My agency, Taylor James and Associates, who has always followed fdcpa guidelines, has always remitted the money they have owed me and is being wrongfully thrown into a fire with a bunch of agencies that have taken clients money and threatened violence. I had heard about this site through one of there mangers and just wanted to throw in my 2 cents. If any customer of mine "MoneyOptions" read this site, please call my office to verify your account and we will direct you to work with them.

I got a call from Taylor James & Associates today and they told me that if i didn't send the money that I would be contacted by and attorney and a bunch of things would go on my record so i'am supposed to send them the money by today or else. What do I do?

Hi Red,

Welcome to forums :D

First things first ??? ask them to validate the debt. You have the right to ask for validation. Enquire about their mailing address and send them DV letter through CMRRR.

Once they are able to send you the details of the debt, then only you need to pay it. Otherwise how can you know who are you paying and whether they will report back to the original creditor or not.

IMHO, do not hurry. Have patience and deal the situation lawfully.

They told me I owed a payday loan from Felxible Money so I called them and they told me that Taylor James was there attorneys and then she said they were the collection agency and that they didn't have anything to do with the loan anymore that Taylor James made the decisions now so I call Shelby Guy at Taylor James and he said that I had until 4:30 today to pay the loan or they would have no choice but to send this to my record on embesselment.

Please understand, you are not violating laws by asking for debt validation. It is your right and third party debt collectors are supposed to provide you itemized details of your debt if you request for. Please go through the article below-

Don't get scared. They will adopt scaring techniques to squeeze money from you, it's their job. You are not running away from your responsibility. You are not saying that you won't pay. You are just trying to walk along the legal path. You are asking for debt validation and you have all the right to do that.

Now if you pay and they do not report back to OC or do not update your credit file, then you won't have any clue to fight the situation. That is the reason you should see some written document before paying them.

Keep negotiating your lender too and try to settle the debt with them. It will be easier for you. Check it here-

I just received a call from a Mike Weinstein who left his number, ext and said I needed to call him back or my attorney. It was imperative that I call back. Well I called the number, blocking my own number out of course and learned that it was from a firm called Taylor James & Associates. Naturally, I got a little nervous and assumed it is pertaining to a collector. I am glad I read this because I don't need to sit and listen to someone threaten me about what they are gonna do if I don't do whatever. Not today...thanks for the information. I will handle this the lawful way.

Every month this company Whistler Holding Xpress Cash keeps taking money from my bank account and I have no Idea who they are. I have tried to contact them and this if the first and closest I seem to have come to receiving any info. Apparently this company is a fraud. I will have my bank stop all payments and expect an explaination and refund.

Just a word of advice, this company is doing the same thing to may account. In a 14 day period they have gone into my account 6 times trying to collect funds. Needly to say my account is in the negative. When I called the bank to get advice I was told to pay the amount in the negative before I can close my account. Even if you dont have money in the account, they still try to garnish funds. I asked for a breakdown of how they come up with these figures, and I was told by Gerald Smith (rep.) that he would'nt give me that information until I paid them $260.00.

I have also been trying to get ahold of this company to see if I owe a balance.. And there is no phone number listed.. If u all have a number for Whistler Express Holding I would appreciate someone posting it. I tried the previous phone that was listed for someone here and it dont work.

I am also having problems with WHISTLER HOLDING XPRESS, when I got my payday loan, this was not the company that I contacted. When I checked my bank, to see if my money had been deposited, there were 2 loans on there, and the one from WHISTLER is one that I did not ask for. Since then I have been trying to contact these people to see how this mistake was made and to get them to take their money back. I can not get anyone to return my messages. I don't know what else to do. I want to pay them their money back, because they did deposit it into my account, but I never asked for money from them. They keep debiting my account for payment, but will not let me pay it back. I do not know what else to do. Has anyone ever stopped payment at the bank? This is the only way that I can think of to stop making this payment, that I should not have been making in the first place and I am hoping that will make them want to contact me. Have other people received money from them and did not ask for it? I knew that a payday loan was a bad way to solve a money issue, but I did not ask for this. I only contacted one company, they were very easy to deal with and I have already paid them back in full. But this WHISTLER company is just impossible to deal with, especially since I had no idea who they were to begin with. They are just taking advantage of people who are having a hard time, but they are not going to continue to do it to me. I can not keep paying this payment to them every 2 weeks until the end of time.

I had the same problem with them. I finally stopped payment on the company name. They try different names to try to fool you and wait for a month or two to try again with odd debits such as %110.21. I finally changed my checking account number.
