Well i contacted them and told them voice this time they were no longer authorized to debit my account. Was put on hold and given to a supervisor and I told him i emailed and faxed the revocation letter to them and they had best not do it. Of course he stammered a minute and said okay but now i will owe them a lot more money because i am defaulting on my debt. I stated that their fees where not in accordance with oklahoma law and the terms of their contract requiring ACH debit were not either as stated in OK State Statute Title 59 and that they were not licensed to conduct business here. Then i got the legal department will contact you. I said okay no problem and I am sure my attorney will contact you as well. Would you like his number now? "click!" They hung up on me. When i called back and got someone and gave my information...."click" Then i tried to access the website to copy it to show the fees and low and behold i was already blocked out. Guess they are scared. Just thought it was funny and wanted to share that with you all and to all the moderators..thanks for all your advice and help..i so love this site!

well its you all that got me fired up to dig all the laws up and gave me the links to get started..i have a new goal..to put these guys out...i have even seen them nail my soldiers..but soon members of the military will be protected by the 36% cap which will rid us of some of them...but i would like that cap for all of you...i am going to start writing my reps in DC and in the state of oklahoma. because our apr cap right now is 390%.

yeah i knew the implementation instructions but i cant find them anywhere yet..either way the companys are in violations of my state law. I am going to request a PIF letter from them. See they can be fined 1000 per violation of the law and rollovers arent allow here

this is what i sent them to their customer service people prior to calling them
Quote:

Customer States:
>
> I revoke all wage assignments and revoke any access to my bank
account until some issues are resolved. You have overcharged me pursuant to
Oklahoma State Statute Title 59, which states can only be charge $15 per
100 loaned up to $300 then $10 per hundred from $400 to $500. Contact
me so this maybe resolved. Also pursuant to Oklahoma State Law you may
not ACH debit my account.

You may find this odd, but NO I dont work for Payday select or Payday OK (they are affiliated) Anyways I had several payday loans with both companies (3 total at the same time) They never once contacted me via phone, I always responded via email to anything they sent, I sent via email payment arrangements,,, which they accepted but when the home equity loan didnt go through because my spouse did not agree, all I did was send them an email to each account I had and they replied the same thing about me not being happy with them and they would consider my account paid in full, I received that for all 3 loans, I am not saying this would work with everyone, I do know that the other pday loans I have have not been so accomodating,, but you know what? I am NOT backing down to them either. Intimidation doesnt work for me because thanks to this site, I have researched the laws. I am not trying to back out of what I rightfully owe, I just expect consideration and respect and until I get that,, I am NOT paying these payday lenders another penny!

The main problem with these places is that there is no check and balance (we know that already, so I'm just stating the obvious). But I read the above post where they send a PIF letter, and that's not enough if you are owed a refund.

Being licensed in IL means that once a year a state auditor comes into my office on a surprise visit, shows his/her badge and then they start pulling all my files. They take up a desk for about 8 hours and look at all my loans to make sure the calculations are right. If a customer pays me more than $1 what I am entitled to collect, that auditor better see a refund check sitting in the file or I will be written up and fined.

Back in the 60s when our company first opened, there weren't any regulations per se. My last boss, who retired, told me back then they might do a car loan for 24 months but send out 26 payment slips. 8 out of 10 people would just keep paying until they ran out of slips. Today if we tried that, we'd lose our license.
