K, is it a Collection Agency? or the collection department for a pdl? If it is a collection agency, there are laws regarding what they can do. I had my pdls refered to collections...what i did was request validation of the debt and I faxed it and mailed it. The calls stopped (from one company) as soon as I faxed the letter. I was sure to follow up with a letter sent certified return receipt...here is a sample letter that is posted on the fourm. It includes pretty much everything....including no contact...you just need to change the information to refelct your situation.

Here also is a link to a sticky on the Dealing with collection agencies fourm ...the sticky is about the Federal Debt Collection Practice Act, which governs 3rd party collections.

Ok people, let's start by saying if a collection agency is calling you, then you haven't paid a bill. They are doing there job. Let's look at how this works.
1st the consumer takes out a loan,or applies for a credit card.
2nd the consumer starts paying back said so loan or mnthly card payment
3rd loss of job, illness, divorce, ect causes miss payment
4th creditor(inhouse) starts collection process.
5th after 120 days of non payment the creditor charges your account off.
After the original creditor charges your auto, revolving, credit card account off it's sold to a broker, attorney, collection agency. Now remember just as with a home loan, the note gets sold.
Please remember that you did sign and or agree to the terms of default when said so account was opened.
Now you start getting calls! What did you expect? Poof! Free Money? Maybe in your dreams. People we all have to look at the big picture...400 billion in consumer debt. We are the cause of this. Our own inability to manage money.
You have stopped paying for something in which you received goods or service. You are responsible! Plain and simple. If you couldn't afford the monthly payment or loan then you should have not taken it out. Collection agency's are not customer service nor are collectors. You wavied you right when you stopped paying your bill. To a certain extent there is a need for politeness when dealing with these situations, but let's face it, how polite would you be when someone calls you while your watching a game or your soaps, and reminding you that you owe money to someone. I think we know the answer to that. So many are so quick to point the blame on the collector or agency, but what about the creditor,or agency that's out 5-10-20 or even 50k? There the bad guy's or girl's because they left message for you at mommy or sis's house for you. Oop's I forgot to mention, since you charged off your account you moved, switch'd job, and changed your #! So again, what did ya expect? People you owe the money! Now it's this and that, I have no money,it's not mine, my sister's boyfriend's mom spent the money...bla..bla! American's in general have became so lazy and ignorant, now even something as paying your bills is now just another excuse. I also understand people also love to just look for the easy way out. Let's charge up a credit card, forget about it,then when a collector calls, start crying and call up a attorney because they left a message for you at work..(which they can do). If we all took a bit more responsibility with our finances, and living within our means, you wouldn't be receiving collection calls. The fact of the matter is we need collection agencys. Just think if there wasn't agencys,we as a nation would be screwed! I'm what you would call a X-debtor. As like many I read about, I to was laid-off,and crushed by the economic down turn. I lost my home, car and almost my family. I started getting calls and messages, I got very mad,but I was ignorant. I blamed them for my actions. I made every excuce in the book why I couldn't pay,all the while watching my 50' LCD while sitting in a plush recliner.... That I bought with a credit card...when my bank account was stacked. Then PooF! All gone. So what? Because I was laid off and couldn't find a job,I shouldn't pay my bill's? Right? Just wait till a collector called again and call my attorney to sue him for something..anything.. Maybe a 1? Hmm actually I should have been the one getting blasted. Why? Simple I signed a credit contract,in which allowed that creditor to recoup any unpaid sum,by any mean's with-in law. So I thought, what if this was my business and I lent someone 2k and they skated on me? You can answer that one. Well I deff diddnt like receiving collection call's from this place, but what I did appreciate was the guy and some lady, with a raspy voice,to explain the whole chain of events, and how it effected me. Let me say no one wants to pay money back for something they don't have or can't use,but without these people, we(EVERYONE) would be really screwed! As if were not already! If we keep spending money we don't have.... Our future looks very dark. Take the time to ask questions, these people will work with you. Again they are people, most being in simmilar situations. Stop blameing other people for you shortfalls. Manage your money, live with-in your means, and if you end up getting collection call's....u have one person to blame...YOURSELF!

American, if you'd read many of the posts on this forum, you'd see people DO want to pay off their PDls', however the companies aren't willing to negotiate payment options in any way, shape, or form. And for many of us who've used this site for a long while, we're more educated about the PDL's, their "weasel words" in their contracts, the fact that many of them have no business approving loans in our State, etc.; hindsight IS 20/20. A little bit of compassion? Please?
