Cease and Desist & Overpayment on previous PDL's

2 questions. I'm in KY. I have a loan with My Cash Now which is defaulted. Over the last 2 years, I've had multiple loans and always repaid each and everyone of them and one time. I can assure you that I've paid way more to them in fees than what exists on this current loan. This is an internet loan. Can I apply those over payments to this loans principle?
Also once a C & D is sent is the 3rd party agency allowed to contact you legally once more. I thought that the final contact had to be made in writing and not via phone?
Can anyone clarify for me?
Not to mention they called one of my references and gave them all the information about my debt to them amounts, date loan was taken out and amount they are trying to collect.

A violation of your privacy, however, keep in mind you are dealing with criminals, this company didn't follow the law to begin with or those loans would have never happened, so it's probably nothing more than a pipe dream to think they will start now. Sorry. :?
