I am getting the same kind of calls. The phone number calling me was 908-988-4266 & the gentleman has a thick Indian accent.
I informed him that payday loans I took out were being handled by a company for me on my behalf and that I would be happy to have them call him. I'm waiting to see what happens.

He said that I was being accused of breaking three federal laws. I have had payday loans in the past but did not remember this one so I called a number for EME and the represetative who answered the phone said that I did not have a loan with them. I also called my bank to see if I got a deposit in that amount into my account. They looked from Dec 2007 to May 2008 and said that no deposit for that amount was listed or any amount from EME Marketing. I called Officer Robert Richman back from ACS and told him this and he said that I was wrong and that I needed to sign the fax he sent me authorizing them to take the money out of my account. They want 820.00 to settle this. They some guy called me saying he was from EME and that he had my application for the loan in front of him and that I did get the funds. He gave me my license number as proof. I told him that I contacted the bank and that they did not show any deposit for that amount at the time he said I got the loan and he said that I was wrong and he was not going to argue with me and hung up. I don't know what to believe. I don't want to lost over 800.00 to fraud but I don't want to get into legal trouble either and with payday loans having so many different names I afraid that I may have gotten a loan from them under another name at a different time. Also I already confirmed my debit card information with them so they might still be able to take the money out of my account. Anyone have any advice?? |
first this guy will be in jail before you are,and i would cancel that debit card, and get a new one.after that i would file a police report for the threats as they are harrassment.then file AG,and FTC complaints against this bottomfeeder.then proceed to ignore him as he can't do anything except call.hang up on him when he does call as that is what he deserves.

Certainly they are blowing smokes. You can't be put to jail for not repaying a loan. Ask for their mailing address so that you can DV them.
You can search EME Marketing in the forums to read more about them and also may read the following thread about collector's scare tactics.

What state are you located in? You can't go to jail for owing a debt and it is against the law for someone to impersonate an officer of the law, I am willing to bet "Officer Robert Richman from ACS" is a BIG TIME scam artist. You need to file complaints against this company with a detailed report of what happened to your state attorney general's office, and the FTC. You can file a complaint with the FTC online, the link is in my signature. You can locate your state attorneys general's website by googling it and most likely fill out a complaint online with them also. If they call you again hang up immediately, tell them you will NOT discuss any alleged debt on the telephone and want them to send you a dunning letter (letter of collection) in the mail asap as required by the federal law (FDCPA)!
