Oh dear, I do know from reading other posts from other members that BOA is VERY difficult to deal with. Speak to the Branch Manager and tell them you want a HARD DEBIT BLOCK placed on your account asap! Tell them you are dealing with a possible stolen identity, perhaps that will make them act faster! After you have your account secured, you need to send letters to each and every one of your lenders and tell them you are revoking their right to debit your account, also tell them you are revoking any and all wage assignments you may or may not have signed. FIRST and formost, insist on having your account FROZEN so there will be NO more funds coming out. Tell BOA you have revoked ALL ach transactions in writing to these companies per the EFT Act (regulation E). They (BOA) MUST abide by this law!

Florida requires internet based pdl's to be licensed by your state BUT, FL is known to have payday loan companies acting as CSO's (Credit Service Organizations). This means they do not need to be licensed, and are generally 100% legal in what they charge.

Question.... What if I cannot get bank of america to help me and freeze or close the account? I have 2 accounts with BOA. One I used only for payday loans, and is in my name only. The other account is mine and my husband. Can they get money from that account?? I have stopped my direct depoist. But I will get fees if BOA will not cooperate. Do I still send letters to the companies that I have way paid off my loan due to all there weekly fees, even though I have not yet defaulted?

Well I have officially decided that BOA SUCKS!!! They will not put any holds on my account. I can close it but it will reopen as soon as the PDL compaines try to get their $$. Then I can close it again, only after I pay the fees that pile up!! I think you should be able to close an account with out having this problem. I really do not know what to do now.... Has any one else delt with BOA? What did you do?

I've had loans with Ameriloan and Genivia as well as others, two years ago. I had 6 loans and it got to the point all I could do was pay them every pay day, then go back and get a new loan to pay the bills and there was no way to stop the cycle. I couldn't pay most of my bills, such as credit cards.
I stopped paying the payday loans altogether. I didn't put any money in the Bank so they would bounce. Sometimes they would put it through 2-3 times. Then the bank closed my account.
I put myself on a budget, after the mortgage, elec, water, gas, groceries and credit cards, I determined what was left that I could start making payments to the Bank and payday loans.
Then when the payday loan company called me I set up monthly payments until they were paid in full. They asked why I couldn't pay it and I told them my roommate lost her job and I had to take on all the rent (was true). You can give any excuse such as illness. I also told them I had 4 payday loans and couldn't pay them much as they all wanted payments every month. I advised them how much I could pay them each month until they were paid. They tried to get more than I could give them, but I just stood firm in what I could pay per month. It took several months but they are all are paid back now. There was one I couldn't make any payments on until one of he others were paid off. So as soon as one was paid I called the the last one and made arrangements with them. One of them didn't even call me until just this month. The principle of the loan was 500.00 and they wanted to charge intrest and other fees which was over 1000.00. But if I paid w/i 30 days I only had to pay the principle. So after two yrs I have now paid the last one.
Since this time, I no longer write checks. I do have a bank account, I pay my bills online or with a money order. And I'm working on a better credit score.
This was a very scarry time and I had a lot of anxiety, was always worried about all of this. I don't know if payday loans report to the 3 credit companies but the bank and credit cards do. So they were my first priority.
If your credit allows you too. I'd recomend a personal loan, enough to pay off the payday loans. Or call each payday loan one by one and tell them due to loss of job (or something) you don't have the money to pay them the next pay date. They will tell you what will happen.
In my experience if you let the pay day loans bonce, then call them to say it bounced and ask what you can do to make montly payments to pay it off, they will work with you.
Since your bank keeps opening the account when they get an EFT they will keep charching you insufficient funds. And the pay day loan will keep putting them through but I know with Ameriloan when I called and explained that it bounced and that my roommate lost her job and I had to pay all the rent and bills and didn't have anything left over they worked with me and set up a monthly payment.
If your credit is being hurt by not being able to pay other bills, then it can't be hurt much more by taking all your money out of the bank and let them bounce, bounce, bounce.... Then work on paying the bank back and the payday loans one by one.

Make sure you don't keep any money in your bank account, if you get your pay checks direct deposit. Stop that and get a paper check, you can take the check to the bank the check is written on to cash it. If employer doesn't allow paper checks then ask a family member (sister, etc) to allow you to deposit the check automaticly in their account and have them draw the money out for you to pay your most important bills (Mortgage, elec, water, credit cards).

BOA truly sucks and here's what I had to do...
I am sorry to hear about your problem with BOA. I had to take copies of the state law showing that the online PDL was not legal. I also took copies of the letter I had mailed certified to the company to stop payment.
Had to put a stop payment on the company specifically, though they changed the withdrawal amount and their name several times. Finally, while at the branch had to speak with someone "higher up" about stopping the continued "attempt" to withdraw. They said they had just had another individual with the same problem with the same company.
At last the debits stopped and because I had put "stop payments" on BOA waived the fees specifically related to that debit. They were REALLY difficult to deal with. I had to open another account and when I deposited money into the "new account" they inadvertently withdrew whatever they wanted, with no notice to me...another long story..., to "pay off" the other account that had been "wrecked" by the PDL. OMG I do not wish BOA or online PDLs on ANYONE after that experience!!!

Thanks everyone for all your posts and stories. I did not give up and finally get someone at another BOA branch that would help me. She said since my account was in good standing, and had been for 5 plus years, she saw no reason not to help me, and closed the account, with a balance hold so nothing would make it re-open.
As of 6/24/09 I have not yet defaulted on the loans, this coming week when they try to take their money, they will not be able to. So I am waiting for the calls to start after that. I have contacted my references to let them know they may get calls, but I plan on answering my phone and dealing with these companies. Some of them, I have already paid 10X the amount of the loan, and I will not be sending them a dime more, only a C&D letter stating what I have paid to date, and that I am to be considered PAID IN FULL.
Some companies I will pay back, as in reality I do still owe them the principal loan amount, less what fees I have paid to date.
I will be sending C&D letters to all of them, I hope that will work for at least harrassing my references and work.
This site was a life saver of information, I know it will take time, but I have learned BIG LESSONS, and I will get through this. I feel like I am getting my life back in control.

I already have their address and am sending my C&D letters today. I do not owe them anything, they have taken all their money already, I just wonder if they really will stop calling????

Before I went to BofA to deal with my pdl's I was fortunate enough to read some posts on this forum about difficulties closing bank accounts so I was forced to be dishonest and tell them my wallet was stolen with my checkbook and debit cards. I immediately went to another bank and opened an account and re-directed by Direct Deposit. You need to protect your interests.

(I have a good story) :) :) :) and once I have asked them for Licence and copies of my debt, they are dumbfounded!! So we will see what happens with those.... and it is working for most of them. However, it is not working for GECC. They have sent me to Alliance Asset Management. This place is a JOKE!!! I just laugh at them, they call 6+ times a day, I answer my phone every time, listen to the same speech that they read from a computer screen. How silly. The 12th time they called this person told me I will go to jail. Well I put 2 reports to the FTC, and I am sending not only GECC a letter but also AAM. Has anyone seen the calls stop from AAM after you send a letter?

i also would file AG complaints againsy AAM.they are a bottomfeeder that collects for GECC.both are not licensed in my home state of IL,and went away quick when i filed the AG complaints.do that on topofthe FTC complaint as itwill take alot of complaints to precipitate action.as opposed to the AG who will investigate sooner.

Okay, so these people are still calling me. I have sent C&D letters, faxes to not only GECC, but also AAM. I have filed complaints to the FTC, FL AG, and the BBB. Why do they still call??? So far 3 times since 9am. I have answered the phone every time. They are telling me I am "STUPID" and that I have not done any of the things I have stated above. I will go to jail If I do not pay this debt. I paid GECC over 2100 dollars. I am standing firm, I know the laws of my state and have armed myslef with everythig I can, thanks to this site and everyone on it. Is there anything else I can do? I have to answer my phone, as I work from home, so changing my number and not answering the phone is not an option. Any other suggestions to get AAM off my back? I am actually surprised, the other companies have left me alone, and I had PDL's with 6 companies, GECC, AAM is the only one harrassing me. Thanks!!!
