HELP HELP-now what?

I recently submitted a revocation letter to American Web Loan and OnlineAdvance.com. Also, I've contacted my bank who's working with me on this. American web loan responded with the following thread...what do I do now?!!:

As you are an illegal lender, I, Laura Skonberg, hereby revoke authorization of any and all EFT/ACH authorizations by your company to any and all of my personal bank accounts. I also revoke any and all wage assignments I may or may not have signed with your company. I will pay the remainder of my principal on 10/15/12 via phone and a prepaid card, totaling $40 as I have already paid you 360.

Thank you! I will need an email confirming receipt of this email. Also, letters have been supplied to my bank and employer.

I have not heard back from you regarding receipt of this email. Please respond as soon as possible. Furthermore, I wanted to inform you of my intention to by the remainder of my principal on 10/15/12 via prepaid debit card on the phone. As I have paid you $360 so far (three payments of $120), I owe you $40 for the remainder of my principal. I revoke any further ACH withdrawals from my USAA bank account and any wage assignments. I am not a member of your tribe nor am I subject to said laws of your tribe.

Dear American Web Loan,

It has come to my attention that payday lenders must be licensed by the state of Tennessee in order to offer loans to its residents. Since your company has no license in my state, the loan contract I have with you is not valid. Furthermore, your finance fee and interest rates do not comply with state law. I am not a resident of Otoe-Missouria Tribe of Indians.. I am most definitely not subject to the laws of Otoe-Missouria Tribe of Indians.

Although I am not legally required to do so, I am willing to repay the principal balance of this loan. To date, I received a deposit of $400 on August 8, 2012, and have had 3 bi-weekly withdrawals of $120 debited from my account. This results in an over payment of $220 as the following finance charges and interest rates are the only one's allowed legally in TN:

Lending of payday loan is legal in the State of Tennessee.

Loan Specifications
Maximun Amount of Loan - $500
Term of Loan - Maximum 31 days
Maximum Rate of Finance and Fees- $30 or 15% of the check (whichever is lesser)
Finance Charge on $100 loan for a 14 day period - $17.65
APR for $100 loan for a 14 day period - 459%


At this time I am requesting a return email acknowledging that my loan has been paid in full. Also, I would like a refund of the $120 overpayment. A refund check of $120 should be mailed to me at the address you have on file.

I am also revoking authorization for ACH withdrawals and any wage assignment I may have signed. I have given a copy of these revocations to both my bank and my employer. Any future attempts to collect funds in this manner will be blocked. I am also revoking the right to contact my references.

Please respond to this email with acknowledgment that my account has been satisfied in full. Details of when I can expect the refund check, as discussed above, should also be included in the email.

Okay, I got this response this morning:

Thank you for contacting our customer service department. We have reviewed your account and find that there is a misunderstanding regarding our ability to lend to residents of your state. Please refer to the opening paragraphs of your lending agreement for further explanation, or feel free to contact our customer service department at 1.877.636.1353 if you have any questions.
I have also sent you a copy of your signed agreement.


How do I answer it?

i'm on board with the others.let it go.they don't want the 40.00 then they can go scratch.send this email and then let it go.


well it seems you think i'm stupid.again your tribal lender is not legal anywhere.meaning the contract is null so it doesn't matter what it contains.i'm through here.you don't want the 40.00 then you get zip,but i will send no more emails and am not getting into it on the phone with you.


send that and be done with it.

"I set up the pay in full on your website BEFORE I found that you are an ILLEGAL lender. I have already paid you $360, leaving me only to pay $40 to make our business complete. I have also LEGALLY revoked ACH/EFT withdrawals/transactions as noted below. Should you attempt to move forward as noted below, my bank will block said transactions as they are fraudulent. I will provide your company the remaining $40 on 10/15/12. At which time, I expect a paid in full letter and no further contact from your ILLEGAL company.

I am sorry that you have chosen to dispute the legal agreement that you voluntarily entered into. And further I am not sure as to why you have gone online and voluntarily set up a pay in full request, knowing it will be drafted out of your bank by ACH at the same time that you are sending these emails to revoke ACH authorization. I am not sure which direction you wish to go. I am not going to reply to any more emails from you as they are contradicting all of your actions.
You will need to call our call center to discuss your account, no changes will be made to your account. the payment you physically and voluntarily set up online is going to run, it will not be refunded. Once it clears, your business with our company will be completed.

is your bank going to help you?is so then the 360.00 should be returned if it comes to that.never call an illegal lender.again as long as your bank will return,or deny the 360.00 don't worry about it.

I just got another response (which I will not reply to) from AWL. I'm posting it so others can see how the company responds, etc and know what to expect , It shows the complete lack of professionalism from this company and also, i think it's important for everyone to note that the rep has not addressed my allegations of the illegality of their company AT ALL:

Help help! Now what do I do? I just go the following email:
Dear Ms. Skonberg,
While we are terribly sorry that you misunderstand the agreement you have signed, we have honored your request to revoke ACH. I have noted your account that you wish no telephone contact and your loan has been placed in the care of our internal recovery department. Your loan is not satisfied, and your balance is not $40. You will need to make arrangements with our recovery team as you have taken any ability for negotiate a settlement out of the hands of the customer service team with your ACH revocation.

Got called immediately by the "recovery department" and she was horribly rude, hung up on me, quoted that I owed them $650. Said I read and signed the agreement and that I was governed by their Oklahoma laws. She then said she would mark my account as refusal to pay.....

HELP!! what can I do??

American Web Loan does not appear to be licensed with Tennessee to engage in the business of deferred presentment services. Also attached is TCA 45-17-101 et seq of the Deferred Presentment Services Act. Please refer to TCA 45-17-112. I highly recommend that you file a written complaint with this Department by email, outlining the facts, and we will act upon it. Laura, I too am from Tennessee and have been working on some of these blood sucking pdls. Was there a website ( other than this one) that you went on to look up to see what companies were illegal or did you contact someone? This website!!!!! OMG WHAT A BLESSING!!!! I would just right them off. You've offered them the 40 dollars, if they don't want it, don't give it to them. I wouldn't even acknowledge their correspondence. They will try to bully you, lie, and cheat to get more money than they deserve. Don't give in to them. Be done with them and don't answer any more correspondence.
