I've complied a list of all 50 states showing which state's require the company to be licensed by that state, and which one's allow other state's licenses.

** This is just preliminary *** There may be changes to it.

In the above states the internet payday loan company must be licensed by that state and follow that state's laws.


I have 5 pdl's that I took out last year... CASHNETUSA, ONECLICKCASH, B&L MARKETING, 500FASTCASH, AND AAAPAYDAYCASH... I have been paying the bi-weekly payments that they were asking, however it got to the point where they just would not stop taking it. I closed my checking account and opend another one without giving them the new info. They have since started calling my job, cell, home, and my references. They went so far as to threaten my reference that they will sue them if I do not make the payments. I am not sure about anyone else but I have paid far over the amount that I borrowed. I even call the lady back who left me a message saying she was from AFI, some investigation place and asked her why she threatened my friends? I also told her to stop calling me at work b/c my calls are recorded. She told me that the lender said that I have never paid any monies toward the loan... I told her that is not true that they have taken more than what is due. Anyway how can I get these calls to stop as well as the threats?? I live in MD and want to know what I can do to make this go away??? HELP!!

I hear the MN laws recently changed that the PDL companies must now be licensed within MN to lend, is this true?

so if i have a PDL from a year ago, when the laws were that the PDL had to be licensed by any US State, do i have to abide by the laws at the time of my PDL or the ones to date?

I have a pay day loan with GRC Funding in Indiana. borrowed $200 and have paid 5 payments of $74, paid them an interest of $170. they have no answers, they say they will keep debiting from my account until i tell them i want to pay off the full amount of $266.00, i did not even borrow that amount. is this legal. please help me someone....

I have a pdl with cash today ltd, which they have taken over three times the amount from my account. I have talked to them, and told them I was not going to pay them another penny, yet the continue to try to with ACH withdrawals form my account, costing me money. How can I sto them? I am a resident of the state of md.

I am closing my account tomorrow so that my outstanding payday loans won't go through Friday night. I know I have paid more than the principle on a lot of them but after they are done I have nothing of my paycheck left and I can't keep getting behind on bills. Does anyone know if they can collect on me some other way in NC? Or can they still send something through somehow. I just have to make my house payment sometime...Can someone give me any legislation or advice on the lenders? They are CashTransferCenters.com, US Fast Cash, Paycheck Today, Cash Advance Network, 247 Advance, CMG Group (Clearwater), Sandpoint Capital, and Huskhawk. I know, I know...I got in bad but all except pne are $300 or less....HELP!!

Can someone tell me the procedures I need to take to stop PDL's from trying to access money (in the process of closing my account) and harrassing phone calls or any letters I can write?

I forgot to mention, I live in NYS and have about 12 PDL's. I talked to the NYS AG and that's all they said that they will send me a complaint form and get back to me in 4-6 weeks. Meanwhile the phone calls keep coming, they have contacted my references (they said that they wouldn't) and they keep trying to hit my account. My account will be closed in about 3 days I'm waiting for a deposit to come through. Please tell me a procedure that I can follow to stop these blood suckers. The NYS AG said that I entered into a binding contract even though the interest rate was totally rediculous. SOME PLEASE HELP.

I would like to know if internet payday loans are legal in Washington DC. We no longer have the walk in payday loan stores they are illegal. I know I borrowed 300 and each payday biweekly they take out 90. And that can last forever and a day. But does anyone know if at all they can practice with a resident of the District of Columbia.

I have about 5 payday loans out and I live in new jersey. they are all internet loans and there are a few of them that I have been paying so much on in interest. I hate that I got myself into this situation. How do I get out?!

Because other jurisdictions besides Pennsylvania are looking to rein in predatory lending, Rob Byer -- a lawyer representing the state -- predicted the decision will "get a lot of national play." The case involved Cash America Net, a major payday loan entity, which is licensed in Nevada and incorporated in Delaware but argued that it did not need a license to operate in Pennsylvania -- which until 2008 had allowed out-of-state Internet loans as long as the provider was governed by the laws of another state. That year, the state Department of Banking revised its rule to require licensing by Feb. 1, 2009, of all non-depository entities, even those out of state, that offer loans carrying interest of greater than 6 percent. The Commonwealth Court ruled against Cash America Net, which earned $20 million for online loans in Pennsylvania in 2007 and 2008 bearing annual interest rates of roughly 1,200 percent. Pennsylvania, by comparison, caps lending rates at a default rate of 6 percent -- although lenders that are licensed may charge about 27 percent. "It is well settled in constitutional law that the regulation of interest rates is subject within the police power of the state particularly when it comes to cases involving small loans, which profoundly affect the social life of the community," Judge Doris A. Smith-Ribner wrote for the majority.

I live in Texas. I have several PDL I got over the internet. Because of being scammed out of $1300 I am not behind on the loans, all but two of them I have over paid what the original loan was by using extensions. I won't get any money till my next retirement check in Sept. and I cannot afford to give it all to pay these off. My Aug. retirement check was taken by the bank to pay the OD fees caused my the loss of my $1300. I am 73 yrs old and this is really taking its toll on me, can anyone give me some help.

Here is what I received from the State of Illinois Division of Financial Institutions-

Since you entered into a contract with a lender you are obliged to fulfill the contract. If you get me copies of your contracts, from every lender, I will take a look and see if I can help you in any way.

I live in Massachusetts. And i have a few PDL's I cant seem to make ends meet and everytime they try to withdraw the money its not in there and I get hit with an overdraft fee. I did lie on my application about being a military dependent. My husband is in the reserves. When you cant even buy food I did what I needed to do at the time. I'm kicking myself for it now. My account is -660 because of all the fees right now. HELP ME Please.

I am writing because I have fallen trap to these payday loan companies. I applied for one then took another just to cover the fees for the first one and so on. When I applied for one of these loans online a third party unrelated to the payday loan company got my information and started withdrawling money from my account. I luckily noticed it and filed a complaint with my bank. They researched it, credited me my money and then closed my bank account and reopened another one for me. I did have 4 loans but now only have 3. They are:
Sandpoint Capital LLC (clearwater bay marketing)-originally $200-fee $60-paid off was $380.
Integrity Advance-originally $300-fee $90-have paid total of $380 and still owe $200+fees
Ace Cash Services-originally $300-fee $90-have only paid $90 so far but that is just the fee.
Kenwood Services-$325-fee $75-have paid $150 but only in fees.
I live in PA and understand the laws have changed. I checked the dept of banking website and none of the above seem to have licenses? Even before requiring a license I understand that PA had a cap of 6% on loans? If that is correct do these companies owe me $ for the difference that I have paid? I have not contacted these companies yet. They are due to debit my old account next week. Before I call I want to make sure I have my information straight. Any Advice? Thanks!

I have 15 payday loans! I had a small business that failed and I thought I could get back on my feet financially and everything has fallen through. I am working full time now as a nurse but there is NO WAY I can pay all the fees I owe to these lenders. I have contacted Langhorne Debt Solutions about consolidating these payday loans and paying them back over time. But I am really scared. I live in Missouri and three of the loans are by check to local lenders, the rest are online. I bank at Bank of America and after reading a lot of these post I am afraid I will never be able to close my account and I am unclear but it looks like I could be in big trouble in Missouri if I even tried to? I have borrowed from friends and family all that I can and I am probably looking at bankruptcy if these doesn't work out. But if I am going to be prosecuted maybe bankruptcy would be better? HELP ME PLEASE!!

Hi there and welcome, please start a new topic in the payday loan help section with the following information:
-Names of each pdl company.
-Whether they are store front or Internet.
-How much you borrowed.
-How much you paid so far.
-The state in which you reside.

Today I spoke with Chris Thompson at the KY office of Financial Institutions. He advise me as of Jan 2010 KRS 286.9-035 will become effective. KRS 286.9-035 states:
Any deferred deposit transaction agreement made with a person who is not licensed under this subtitle shall be void, and the person shall not collect any principal, fee, interest, charges, or recompense whatsoever.
(2) The executive director may void a deferred deposit transaction agreement when it is determined by the executive director that the licensee has violated any provision of this subtitle. The licensee shall be allowed to recover from the customer any principal paid by the licensee to the customer, but the licensee shall not recover any service fee or other charge related to the deferred deposit transaction.
(3) For purposes of this section, "payment instrument" also includes debit authorization, electronic funds transfer, and any other form of electronic transmission of money.

Although this seems to help in some ways in also seems to remove the actual check protection against IPDL's from 808 KAR 9:040. Thoughts?
