Now, I dont know if there is even really any recourse in this situation, as I keep seeing so many people who are plagued by these calls, but if there is, Im in Florida, could someone point me in the right direction? I can handle belligerent Creditors, but this is way over the line to me and frankly Im pissed that this jackass would call my place of work and speak to me in this manner.

For at least the last four years, possibly longer, a group has been calling former payday loan applicants advising them that they have defrauded a bank and are now being sued for non-payment of a loan. The callers will claim to be calling on behalf of an attorney's office (name varies), the Dept. of Law and Investigation, ACS, or other similar name combos below:

You will be threatened with arrest, a costly trial and possibly worse. In no shape, way or form can you be arrested for non-payment on a consumer debt. Do not believe these threats, as they are without merit and cannot be carried out in the manner they allege.

The collector's MO matches a once legit collections agency called Ellis Crosby & Associates. Here are some links on them:
They have been previously fined over $1.3 million for various violations. They have been known to use phone banks in India to make their calls, which more or less coincides with the difficult to understand accent many of us detect when we are contacted.

On July 15th, 2010 a Public Awareness Bulletin was sent out by Missouri Information Analysis Center.
"..received reports from individuals in Ohio and Illinois reference suspicious telephone calls they received. In both instances, the callers are reporting that a voicemail is received from a man, with a Middle Eastern accent, identifying himself as an officer working with the Financial Crimes Unit. The message indicates that the reason for the call concerns a loan made by the receiver or someone in the receiver's family. The voicemail requests that a return call be made and a telephone number is provided. When a return call is made, the caller is asked to provide personal identifying information such as their date of birth and social security number.
Reports indicate that the calls are frequent and persistent and that they even threaten arrest or legal action if information or money is not provided. It appears that the individuals making these calls may have access to some records connecting individuals and their relatives. Missouri does not have a Financial Crimes Unit and all indications are that this is a fictitious agency. If you receive a similar phone call, please be advised that it is a scam and please contact your local law enforcement agency or the Missouri Information Analysis Center at 866-362-6422."

Bottom line:
Do not supply the callers with any additional information. Inform them you have reported them to law enforcement and hang up. If you haven't already, go ahead and report the calls to local law enforcement, your state's Attorney General and beyond. Look up the local Secret Service branch's information in your area and get in contact with an agent there.
If you ever applied for a cash advance online, your information is out there.
Possible sources for the breach of your privacy are:
* The fraudsters obtained your information from Teletrack - a reporting agency used by many cash advance lenders to determine their risk lending to you. The service is able to tell cash advance lenders if you have existing loans with other companies, for example. Many state laws prohibit borrowers from having more than two cash advances out at the same time.
* The fraudsters created their own fake payday loan application site. People looking for a cash advance went to the site and applied, thus freely providing the fraudsters with their information for malicious use at a later time.
* The fraudsters were able to get into the database(s) of cash advance lenders - probable targets being Sonic Payday and Cashnet USA.
How to protect yourself:
* Inform your employer. You are likely getting calls at home and/or at work, so make sure your employer is aware the calls are part of a scam and to not take them seriously. Advise the callers that they are no longer allowed to call you at work. If they continue to call, document the date and time of the calls you received. Save voice mails left if at all possible.
* Change your number(s). For some this may not be an option, for others a one-time number change can be done free of charge.
Be advised - any references you listed on your payday loan application will be contacted. Let those people know that this is a scam, and they can disregard.
* Use Google Voice. Google Voice is a great replacement voice mail system for just about any phone number you use. Messages can be transcribed and voice mail recordings can be saved as mp3 files.
Pro Tip - call the fraudsters with a Google Voice number before turning off your old phone numbers. Make sure when you call you identify yourself so they can start up their script. At any point after they have your information pulled up just hang up. They will then start religiously calling your Google Voice number. At this point, you are free to change your regular phone number(s) and enjoy not having these people ever call you again. (And laugh at the fact these people are basically talking to a brick wall several times a day)
The fraudsters change their numbers frequently. Law enforcement used to think it was because the callers ran out of minutes on their prepaid wireless accounts or they were shuttered due to fraud, but now they understand it's simply to evade detection by savvy consumers online. With the proliferation of VoIP, it's even easier for the crooks to stay a couple of steps ahead of law enforcement. Below is just a sampling of the 70+ numbers that have been used in recent memory.

So can they really do anything to you?
It's not a simple yes or no answer. Logic dictates that, if they really wanted to take you for a ride and drain your bank accounts, they already would have.
So, why haven't they?
Authorization.
Why do you think you are being called so much? Perhaps it is because they like the sound of your voice? No, they have to have your authorization to take any form of payment from you, period. The callers know their audience, and that audience is typically a bunch of people that have applied for payday loans in the past. Most of those people they call couldn't afford an attorney if they wanted one, and are so used to receiving collections calls that so long as they sound like a real collector, they will likely be perceived as one.
Furthermore, they don't even really want to talk to your attorney - that just sounds official and scary enough. A real attorney would take the callers to task and write them off as two-bit con artists. The callers need you, in writing, to authorize payment against the fictitious debt they claim you owe. Go ahead, ask them for proof you owe the debt - more commonly known as verification of debt. See what they say. A phone authorization carries very little weight, so if they have something signed by you on file, you are done for - and the callers know that. That authorization is the only thing these callers are doing by the book, and for good reason. If they just went all willy nilly and made an ACH debit from your checking account, without your written approval, you could in turn report the transaction as fraudulent to your financial institution. In about 7-10 business days, you would get the funds returned to your account. Then the fraudsters would be up against a bank and their team of lawyers and investigators.
Bottom line:
If you haven't paid the callers a dime, don't. If you planned on paying them to shut them up, just don't. Remember - you are not being contacted by a legally licensed, ethically owned and operated collector. Read up on the FDCPA - http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf - and know your rights.

jpishkur1111, I guess you could report them to your State Attorney General and your State financial regulatory agency, and Federal Trade Commission? However, if these people are actually located overseas I don't know what-all any US regulatory agency could do to stop them, even if they ARE misrepresenting themselves as part of the Federal Govt. I usually hang up on them but if I'm feeling a bit evil when they call, I usually let them say their spiel and then I try to throw them off their scripts (you KNOW they're using a script); as you discovered, they get all flustered.... ;)

I did receive a call today (amazing how once one of them calls and you answer, then they all call) from Check Solutions of America regarding a PDL from CMG Group that they said was a balance of $568.47... they offered me a settlement of $221.66... I told them the original loan was for $200 and they had debited $300 from my account bck in late 08 early 09... then they said they could settle for $199.18... I looked up CS0A and get some debt help organization and NO listing whatsoever with the BBB... Are these folks for real or should I tell them to pound sand as well?

BLOCK YOUR NUMBER, call them back at the number they leave on your voice mail after a little while, and have fun. Keep calling them back over and over. Tonight I got one guy so mad he last answered his phone with just “hello” and now won’t answer at all and his voice mail box mysteriously will not accept any more messages…..Gee, I wonder why?? :) Since these creeps darn near cost me my job, I decided nothing was off-limits. I told him his ancestors were mud eating pigs, that I did his sister and she loved every minute of it, that I’d do him if he didn’t like it, that his mother had been in more laps than a napkin, that his girl had been around more times than a carousel, and on and on. I asked him about his female plumbing…..oh man I laughed so hard by the time I was done I had tears in my eyes…and these smileballs deserve every bit of it. It seems they can dish the crap out but can’t take it very well. Don’t put up with them……..get yours back!!

This is my unsolicited advice for those that are getting the calls and feel the need to "lay into" the people that are harassing them.
Think before you speak.
Demonstrating in any shape, way or form to the callers that they have gotten to you is a sign of weakness and is pretty much the blood in the water that will attract more of them to call you. Some have suggested doing the exact opposite, meaning not answering their phones at all and sticking their head in the sand while this is going on. While that might work for you, the less time they spend on the phone with you gives them more time to spend with people that are picking up.
If your only aim is to insult them, you've already lost. However, if your intent is to keep them off the phones from other would-be targets, it's a small victory in a war that has been ongoing for years. They stand no chance of extorting money out of anyone if they can't keep the real callers away from the fake ones. I was able to light up one of their lines recently to the point that within a matter of hours it was disconnected and no longer in service. That's one number less than they had, and surely during that time the crooks that picked up couldn't be on the phone with other potential targets to threaten and intimidate them.
The callers may be oblivious to the laws in the US or they simply do not care, but they aren't entirely unreasonable. From a "business standpoint" they can't stand to profit from taking calls that don't go anywhere. Once they reach that point with you, there is no reason to continue calling. Really, it is that simple.
However, keep in mind that since your information was once out there that it is AWLAYS out there.

They only left messages on my phone and my gf's claiming to be the dept. of law and investigation and claiming that i committed financial fraud, but I know that is false since I never got the loan anyway since I have horrible credit. I was so upset by the call I had to leave work. I had put them off by saying I need to speak to my husband to deciede if I want to go to court or settle out of court. He gave me until the end of the day to call back or they would proceed. I left work and got my husband out of work and have time to calm down and starting an internet search and I found out it is all a scam. These creeps just called my friend yesterday, then started calling me at work. We could barely understand the guy, his accent was so thick. He used the name Alex Williams and said he was from the Department of Law and Investigation. I used to get payday loans from CashnetUsa.com and stopped a year ago because my state changed the laws and no longer permits them. My last loan was paid off prior to the new law and no one ever contacted me to tell me any different. I have since learned that it is LEGAL to sell someone's bank account info, social security number, etc! The best way to stop these creeps is to write your legislators, congressmen, and the President and asked that a law be created protecting your personal information from being sold. If you have ever applied for a loan, whether you actually got the loan or not, your information is out there and they can sell it and they do. Most banks are ethical and won't sell your info, but not all of them are and will do anything to bring in revenue. My bank educated me on this and assured me they do not sell personal info and vigorously prosecute people that use the info to steal from your account. On their advice, I changed my bank account info to ensure these scam artists cannot take my money.
Talk to your HR manager and see if they can block the number so you can't be called at work anymore. On your cell, enter the number and don't answer it if they call. They'll give up eventually.

Now they are calling me threatening me. At lease I know for sure now it's a fraud. But I am sure they have my bank account info so I guess I need to go change that. What a hassle. Maybe I'll wait. If they do take anything I can report it as fraud. And if they were going to I would think they already had.

I just saw this! As a matter of fact, I have been collecting some information and working on contacting Dateline, they have done a few programs on predators, well, these overseas lenders are in the same category, don't ya think? Just thought I would run that by you.

I have never been so unnerved in my life. I have seen the advice to tell your employer but don't want to get myself in trouble in any way and jeopardize my job. I have worked for my company for 8 years with no problems of any kind.

This is a complete scam, there is no federal agency by that name, no collection company can threaten to send the cops to your house, civil matters arenot handled by the police.

He gave me an address and everything, that I will be using when filing my complaint against them. Funny thing is I looked up the address and it is actually a residential home. (Pic of it and everything through MapQuest.com.) The idiot actually claimed since I work for a state agency I should "know" he is legit. I just wanted to scream "Dude you are an idiot!!" I did not of course but I love that he gave me all that information to now use against him!!! I am sure at that point he was just trying to swindle me in another way, but quickly learned I was not falling for it. Anywho, just thought I would share my experience! ;)

Another thing you can do is get them to give you their address - if it's legitimate. You can then write a letter telling them that they are not permitted to call you at work. Send it via certified mail and see what happens. If it doesn't come back it means that SOMEONE is taking the mail and then when they call again you have a legal right to tell them that according to your rights, they cannot call you at work any longer. If the mail comes BACK to you... when they call again you can inquire as to why a letter sent to their legal place of buisness which they gave you came back returned. And you can inform them that you've already spoken to a lawyer about the company being fraudulent. I have made the mistake of taking out Payday loans - and will forever hate the descision as long as I live.

I got the dreaded call today, some Pakistani/Indian male, could not make out the name properly, Greg somebody from Law and Investigation Dept left a voice message for me or my attorney to call him back at 760-282-4216, he mentioned something and read my last four digits of my SSN, told me not to disregard this matter.
As i happen to be a Brit waiting to get my restrictions lifted on my Green Card, i thought it may have been USCIS calling, i called the number and it was answered by a Pakistani/Indian woman, now the alarm bells tell me its not the immigration calling. i listened to her script she was so obviously reading, giving me a case number, how i had defaulted on a payday loan ect, she finished, i just stayed silent, observing the busy background noise of others being given the same script, she says you there sir, i said yes, Never had a payday loan, send who you want around, have a nice day and hung up, i will get my neighbour who is a retired police officer to call them when i have made up a script.

I'm in FL also and would like to connect as I'm in the legal industry and would like to get an attorney to go after these people and or company who is doing this to people. This is the second call in 2 months I've received from these people and they are very rude, bold and could very thick accent. I'm part Indian and am taking this very personal that these people or conducting business this way and with Indian or Pakistani desent. I had been receiving calls from these people for approximately 3 months, but I would just ignore them and send the calls to voicemail as I knew I had no outstanding loans. One day while at my work, my cell phone rang with *0000. I answered the phone, then hung it up. This happened three more times with me answering/hanging up. Approximately a minute later, my work phone rang with the same number. I let it go to voicemail and they did leave a message. It was a Middle Eastern male named John Matthews (ha!) who rattled off the last 4 of my social and demanded I call him back. This was the first call that I had ever received at my work number and I didn't want to continue to get calls from these people, so I called back. I had already researched the strange number that showed up on caller ID and found all sorts of posts from others receiving these calls and being threatened with being arrested the following morning, so I was prepared for that when I spoke to someone. He said I had an outstanding loan, I said no I don't, he said is this your social and read it to me, and I said no. He read it one more time and I said no that's not me. Then he said I had defaulted on a loan and the police would be at my place of employment to arrest me. Here's the funny part; I work for the local police department, so I told him, "Oh really? Because I work for the police department so they won't have to come very far to get me from my place of employment." There was dead silence on the other end for approximately 5 seconds and he then said I owed the loan. I told him, "You do what you gotta do," and hung up. I have not heard from them since.

This guy Edward Walker (one name used) started to call me around 4 months ago. He had a different number back then. Right now he is using a company name "Law investigation Dept". Which has changed from American Law (or something like that). He threatened and harrassed me for money, and said he will take me to court (never happens). I told him I was turning in all his information to the FBI, which stopped the calls at least temporarly. I have contacted the police about him, and they told me I needed to inform the local FBI unit. Bad addresses
Whatever address they give you is usually an apartment, house, and recently they gave me a school address. Go on google earth and you can zoom right in and look. Plus, they hem and haw when asked for the address. One would think they would know right away. LOL

This information is going straight to FTC on my own behalf. What they are doing is illegal. He does not have a govt id number or any other kind,. I think the local police should be notified because he keeps threatening me by saying I was in bad trouble and he was going to come to my house. This agency needs to be closed and fined to pay everyone he is threatening. He must be getting some one to pay. It won't be me. I got another letter today. I have had enough. He is goning to find out where this scam took place. A scammer scamming a scammer. Heave. It is time to pit these fools against one another. Any other laws that are run across, please pass. While he, the same man each time is starting to curse people, He needs to be deported.
Start asking him question as soon as he calls. Tell him to hold on and leave him there. Ask them what is their company EIN with the IRS. enough is enough
