New to Site and Need PDL Help!

Hello Everyone. I also am in a payday loan nightmare. I have 3 pay day loans. Where do I begin to get these resolved. I did close account but not sure what will happen when they try to draft out because my bank left open only a certain amount for some pending charges. I live in texas by the way. I have CashNetUSA, ameriloan, and OneClick cash! I've definitely paid enough in fees to pay these 3 off. Any suggestions to where I should begin first before all the harassing begins? Hi Jenny.
Someone will be along shortly to give you the laws for Texas. I just paid off Cashnetusa on my own, they may be able to work with you. I put my others with a consolidation company. WE've all been there, so you will get good advice and great moral support! :wink:

Jenny, Welcome to the site. I see you are in Texas. Can you tell us how much you borrowed form each and the total of how much you have paid back to each. I can tell you this...Cash Net USA is going to be licensed in Texas...they are not a pdl in Texas rather a Credit Service Orgranization (CSO). You are going to need to contact them and work out payment arrangements with them. If you want to know more about them, you can search them in the box at the top right side of the page. There are quite a few members who have had loans with them who have had to work out payment arrangements with them. This is a really good thread to read about CSO's, Cashnet USA and your bank account. Please read over this and let us know if you have any questions.

ameriloan and One Click Cash are under the MTE umbrella and will not be licensed to do business anywhere let alone Texas. If you could post the information requested we can point you in the direction to go with these two pdls.

CashNetUSA Borrowed 500.00 and have paid 549.49 in fees
ameriloan Borrowed 350.00 and paid 470.00 in fees
OneClickCash Borrowed 400.00 and paid 530.00 in fees,

After typing this all out, I realize even more so horrible they are. That's so awful! Thank you for your help!!

Jenny, Please do not fee so bad. It is horrible but you are taking a stand and doing something about it...and you are not nearly as bad as me...I had 9 of those suckers. Now....As I posted above, Cashnet you will need to work out a payment plan for and when you open your new account do not give them your new account information. Insist on money gram or money order or prepaid debit (which ever you are more comfortable with).....As for ameriloan and One Click, they are unlicensed and illegal, and you have way overpaid them...

You are only obligated to pay back the principal amount you borrowed from an unlicensed/illegal Internet Payday Lender. I know you already closed your account however, I included this so that you can be sure you blocked the pdl's access to your money.

What should you do?
Be sure your account is closed or you atleast have a debit block placed on your account immediately! Be sure the pdl's can not take your moeny...Explain that you are revoking ACH authorizations from unlicensed/illegal companies, and have learned these companies are notorious for ignoring revocation, therefore it is important to BLOCK any withdrawal attempts on your account to protect your interest. What next?
AFTER your account is secure send each pdl (the unlicensed and illegal) an email similar to THIS (please scroll down to locate letter template). Tailor this letter to your needs, and try to write it with the same basic concept in your own words. You will need to research and locate email addresses/physical addresses if you don't already have them, I suggest that you type the name of the pdl (example: "oneclickcash address") in the search box in the upper right hand corner of this forum. You may also search for addresses HERE at the Better Business Bureau.

File complaints: Most of the time, you can file a complaint online with the following, I encourage you to follow through with doing so, you will need to search the Internet for your state Attorney General's website, however, here are links to file complaints for the FTC, Online complaints: Federal Trade Commission., and the BETTER BUSINESS BUREAU.

Keep in mind that you may not receive a response for days, or even weeks, or, you may receive harassing and threatening phone calls. I have found the best way to deal with this is not to respond or reply, simply hang up.

Side note: If you have paid an illegal/unlicensed payday lender above and beyond the principal amount you borrowed, it might be a good idea to demand a refund and a paid in full letter/receipt. You may or may not get one or both. It still doesn't hurt to include that tidbit in your letter. :)

Jenny, Good work... keep us posted. I will tell you that both companies are part of MTE and they are pure evil. Expect them to call, expect them to tell you that your state law does not apply, that they do not have to be licensed in Texas and anything else they can tell you to get you to pay. Just hang in there and post if you have any question.

Jenny, you can do a couple of things. Me, I just let the phone go to voice mail, or gave them a silent ringtone to my cell. I tried my best not to talk to them because it generally went in circles, nothing was achieved except them yelling at me. I would tell them I was on vacation if I was at work and I even told them I was fired so they would not call back. Eventually, they will stop calling....After every call, I would send them an email and attach my original letter. I kept track of the calls, dates and times, who called if they left a message with a name, and included them with my complaints. IF you end up having to talk to them, stick to your guns. Reiterate what you stated in your letter. DO NOT let them bully you into thinking you owe more than what you have already paid, or anything else they may throw at you. They will say anything, and I mean anything to get you to pay....also read

great job roxy,one other point.these places you will have to fight for a bit.they won't just give up.illegal companies almost always never do.just do as roxy advised and you should be fine.
