Hi I had a few payday loans ONLINE and I went through alot on the past few years. I lost my job, vehicle, apartment and both my bank accounts were closed due to over draft fees and non payments. I havent done much to keep in contact with the people I can honestly say but I finally recieved a phone call from a private processor from a guy from a company called Western New York Capitol. He says that I have a case of defrauding a federal instution and check fraud because I took out a payday loan and that my bank account was closed. This was not intentional. I was dumb and tried getting payday loans to make ends meet to survive while struggling with jobs to paybills but it wasnt enough. The guy claims if I pay the debt off they wont take the case any further and that they wont serve me with papers. What are my rights? the pdl provider online was cashnetusa.com I have been restless and haveing extreme anxiety. Im so upset think that I am going to jail when I didnt intentionally close my accounts. I mean my credit is literally screwed and thats obvious so how could they say that I did this on purose, to practically become homeless to get a small loan of 350.00 online. Help someone please. I need answers

Woegie, just relax, you'd be just fine :)

Well, you need to help us with the name of your state so that we can look-up the state guideline about online payday loans.

You can't go to jail since there is no jail in USA to put loan defaulters. Even if there is one I'm sure it'd have been over crowded by now.

Anyway, closing the bank account is one way to keep the payday loan sharks away from your money.

Almost the same has happened to me. I took out a payday loan and was not able to even make the first payment. Now they are threating me with fraud charges. When I took out the loan I was employed. One week later I was layed off and unable to pay. When I took out the loan I did not intend to not repay it.

payday one. They told me this morning on the phone it was fraud because I took out the loan and never made a payment. I told them I intended to pay, but I had lost my job. I told them I was very much searching for a job and intended to pay as soon as possible.

As far as they are concerned the account was in default and it was fraud.
