Hi,
I'm also new to this site and pretty clueless as to how to post etc. I'm in a terrible situation and am desparate. I have at least 8 payday loans (some have to be paid in full every pay day others roll over)and I keep getting deeper and deeper in because I don't have the money to payback, therefore, I get another just to live. I have another pay day this Friday and my check won't cover my loan payments let alone have money for bills and essentials. I live in PA, and all of my loans are from internet sites.

I can tell you right now that as a resident in PA, your pdls will have to be licensed SOMEWHERE in order to be considered a legal debt. If the are not licensed SOMEWHERE, they will not be considered a legal debt. Let me take a look at your pdls.

If you can't totally close the account, then you need to put a HARD DEBIT BLOCK on the account so NOTHING goes through. You will need to open a new bank account somewhere else so that you will have a "working" bank account. Please post ANY questions. I know I have thrown a lot of information at you.

I bank with national city and have never found them to be particulary helpful or customer oriented. Is anyone familer with their ACH policy?

Anything that I can use to find out who they are/where they are? We need to find out of they are licensed anywhere. One name came up and it was a d/b/a of MTE Financial (the name and address I posted and questioned). If this is indeed them, they will not be licensed. HOWEVER, I need for you to verify some information on them for me so I can be sure. Whatever information you have on them, I need it. Okay? :D
littlepuddin - I just check the BBB for the pdl. Then I start checking the licensee database for the state they are in, and move on from there if there are other states involved. :wink:

NOT A PRETTY PICTURE - payments alone will overdraw my account $1600.00 and that's before the OD charges start. :cry: To make matters worse, my bank will automatically pay the draft even if the funds aren't there and just tack on another $37.00. I understand the long-term picture of what needs to happen, but given the proximity of my pay date, what's my safest course of action to get through this pay cycle?

Did you read what was posted regarding closing your bank account? Do you have any questions about it at all? We can help if you do. You are going to need to close your account and open a new account. We advise at a different bank; however, if you trust your bank and feel comfortable in the fact that you're remaining at the same bank the pdls know about, you can open a new account there. It's just better to move on to a different bank if possible. Have you done anything regarding your bank account yet? And when are your pdls due to debit next?

I haven't done anything about the bank, was planning on going tomorrow. I've read the bank posting from this thread as well as some others, and frankly got pretty nervous. As I'd mentioned earlier, I've never been impressed by national city's willingness to help, and not entirly confident that even if I make the trip into a branch, close the account (or put a block on debits)that it will actually occur. I understand that with persistence you can work through charges, but that takes time and what does one live on in the meantime???

Okay, I understand what you're saying. What you'll need to do is go to the branch that you opened your account, speak to the manager. Tell them you have fraudulent activity on your account. Tell them whatever you have to to get them to close it. If they can not PROMISE that the account will not be forced open due to pending pdl debits, then you make them put a HARD DEBIT BLOCK on the account. Nothing will go through. No ATM card, no checks, no ACH debits, nothing. So basically just deposits will go in. If you have direct deposit, you will need to contact your payroll and see if they can stop it and issue you paper checks until you have a new bank account and then give them the new information. Or, if you have a hard debit block put on, your deposits can go in. You would then just have to physically go into the bank, make your withdrawl, HAVE THEM PUT THE BLOCK BACK ON, and your good to go. I took a little bit of money (just a small amount) and went to a different bank, opened an account, had my direct deposit rerouted to the new account (they did it immediately because I told them there were fraudulent charges on my old account), so I had a "working" bank account. I kept my old one on a hard debit block for awhile (I was getting some refunds from overpaid pdls deposited back in there). You can totally close it with the assurance that it will NOT be forced back open. Or you can put a hard debit block on it if they say it could be forced back open. Take just a few bucks (I think I only had like 25.00) to another bank and open an account. Get your direct deposit (if you have it) routed to the new account. Your only fear should be that they say "It could be forced back open." If they say that, then tell them you need a HARD DEBIT BLOCK. Don't just block ACH debits. No, no, no! The pdls will put through electronic checks and hit the account. You're going to have to maybe take the money you have in your account now out, go to a different bank, and open a new account. Or you may have to just leave it as it is with the hard debit block on it so nothing can go through. However, whichever one you do (close/block), you're still going to need a new bank account so you can live like a "normal" person. National City is not hard a$$ed like some banks. They will most likely take care of it for you. But only speak with the manager. They have the "call" on closing accounts. Don't speak to customer service or a teller (learned that one the hard way). If you have any questions, please just ask! We're here to help you through this!

See if you can go in to the bank FIRST THING Thursday morning and put a HARD DEBIT BLOCK on that account. Make them do it NOW. Say whatever you have to say to get this done. Tell them illegal companies have gotten your bank information, tell them someone stole checks, claim identity theft. Do whatever it takes to get this done. They can put a block on in two seconds with the click of a couple of keys. Believe me, they did it for me. Tell them you're working with a lawyer regarding all of this. Just whatever you need to do, do it. Put that block on there. This way your check will still go in, but NOTHING will go out. You need to do this ASAP to catch it before they hit it on Friday.

I know you said I need to go to the branch I originally opened the account - which is a bit problematic since I need to do this during the day and I have several hardwired committments on my calendar and round-trip travel time is 1.5 hours. Any chance this could be done @ a closer branch as long as I'm speaking to the manager?? My other question has to do with a hard debit block. My check is direct deposited and I know this isn't enough time to get my payroll department to issue a paper check. How do I get my own money out of the band if I've had to go the hard debit route?

hey Sharlene, this is Shelly, I was in that situation a couple of months ago..cannr was right..go to your nearest bank location and speak to a manager not a customer service...dont inform them that you signed all these papers because it will make you look bad..tell them you already paid these PDLs and still keep on wtihdrawing from the bank..the first thing they will suggest is to put a stop payment which is not helpful..I found out that when I put a hard block on my account, the PDLs tried withdrawing 41 times on my account, this was because I ask the manager to check on it..just let it stay on hard block until it will eventually close..Open a new account from another bank. after doing all those, get all the addresses of all your payday loans and send them letters about you not wanting to pay them anymore because its causing hardship on your side..if you can, have it certified mail...I have 7 payday loans before...5 of them refunded my money because I actually send them 2 letters..one is the one stating i cant afford to pay anymore and second demanding them to pay me back or I'll sue...they sent me back moneyorder payable to my name...after that I never had to deal with them anymore..the remaining PDLs I let town and country handle it..refrain from borrowing..its hard because you think thats the only way to survive...the chain has to stop so for the next couple of paychecks you'll be able to go back to your normal activity.

You need to do this. I'm thinking going to a branch closer to you might work. Ask for the manager there. If worse comes to worse, they may have to call your original branch where you opened your account to get "permission" from that branch manager. I've had to have branches call my "original branch" for a few things before. They just get the "okay" over the telephone. If you do end up having to just have a hard debit block and you do go in and withdraw your money, PLEASE make sure before you leave that they have put that block back on! They have to remove the block to give you money. So before you walk away from that counter, say "Did you put the block back on my account?" Do not leave until you know the block is on.
And, roxy posted some great stuff to take with you just in case they give you a hard way to go. Print this stuff out, keep it in your purse, pocket, car, whatever. If they don't give you a hard way to go, great! If they do, whip out these papers and they'll know that you're not stupid and you know your rights.

call the branch nearest you first and ask for the manager..in my case. she just put a hard block on my account as we were talking over the phone..I told her that I paid these loans and some of the other payday loans trying to withdraw money from me, I said I cant explain and I think they probably sold my information to a third party..that way the manager didnt think that i authorized all of them..I had to make it sound like Im a victim of a scam...it is actually a scam that I gave permission.LOL..but ofcourse they didnt have to know that..theyre just concern about unauthorize withdrawal...tell them you want the hard block..that way, no other transaction can go in except for deposit..if u need to withdraw money..like cannr said, go to the branch and do a manual withdrawal..after that, they have to activate the hard block again...but i would highly suggest to find another bank and have your paycheck trasnfered there...everytime they deactivate the hard block when you withdraw,its risky.you dont know when these PDL strikes..like i said when i put a hard block on mine, I was informed they tried to take money from my account 41 to 50 times..thinking they'll get something..eventually they stopped..but I do my banking with another bank now..that way my money is safe...dont worry about it..I have a friend who owed 2 payday loans both storefront..and didnt pay...they're still moving on..your basic needs is more important..dont prioritize them when you paid them so much already...the minute you speak to the manager of the bank and open a new bank..then you can think of how to get back at them..write a letter and tell them not to call at your work because it will jeopardize your employment..I did that...one of them called again and spoke to my manager..i freaked out and called them..they paid me back..lol..just hang in there..

Just got off the phone with my bank manager and have placed a hard debit on my account. She also had me report my debit/check card as compromised and its now coded/blocked as stolen. :| Honestly having some mixed feelings about all of this. On one hand its a great relief to know that there is a way out and I've taken the 1st step. On the other, I've read enough of the posts to realize this isn't an easy process, it takes a lot of time/dilegence and I don't have the stomache for it (obviously a big part of how I got myself into this mess to begin with). I know everyone would be appalled but if I could have accessed my 401K funds soon enough I would have taken out the cash, paid everyone off, and considered it a costly life lesson. So, what's next, and is there an agency that can ease some of the burden and is still safe to work with & affordable???

You are right, it is not an easy road and there is alot of crap to put up with..but honestly, I started my road to freedom in August and by December the worst was over. Something to consider, only two of your pdls are licensed, they are the ones you need to worry about. If you want to check out companies, the two most common mentioned on here are Langhorn and Towne & Country. You can read what other members have posted about them if you type the company name in the search box at the top right side of the page. No matter what you decide to do we will be here to help and support you. :D

Thanks for the support and knowing this is a 'judgment free zone' was one of key reasons I was able to make the decision to end STOP THE MADDNESS!! When I initally posted my pdl's took a quick tally based on the correspondence/loan documents saved in email. When I actually got up the nerve to look at my bank info online I realized things were CONSIDERABLY WORSE, & hadn't included several other pdl's. My plan for this evening is to go back to all of my statements, identify all loans, list principle and amount paid. Should I post the final list? What can I do to limit the calls my listed references or colleagues @ work receive?

As for the phone calls, it is difficult to get them to stop. I spoke with our operator and asked that all calls for me or in reference to me be put through to my voicemail. My coworkers knew I had fruad on my account and were more than willing to play along and would tell them I was fired or that I quit. You can send a letter telling them to quit calling, however most of the time, they do not follow it.
We have all been where you are and know how you feel. No one can understand better what you are going through than those of us who have been there. I remember the feeling the day I sat down and figured out who I owed to and how much I paid them...I was physically sick for days...I had paid out so much more than I borrowed. You will get through this...and we will hold your hand the whole way. :D

We've had members here with up to 20 internet loans. Do not be afraid to be open about your situation. No one, and I mean no one, is going to judge you or think bad about you. This is your "safe place" regarding all of this. I have told no one about my whole pdl mess. Not a soul in the world. The only people who know about my 'secret pdl life' is this forum. I trusted these people with something I wouldn't even tell my family or best friends. I can now say that doing it myself with the generous help of the members here that I am pdl free. It was work. It was ugly. But the payoff is wonderful. The support here is unreal. And you will have people helping you every step of the way. It still brings tears to my eyes remembering all the support and help I got. You don't know how fast people responded to my pleas for help. I thank God every day for this place and my "normal" life now. Sharlene, if you want to try to do it on your own, we can help you. If you want to contact a company to do your "dirty work" for you, then do so. It's your call. Whichever you decide to do, it'll be what's best for you. Only you know what is best for you. Sharlene, tell your workmates youre a victim of a fraud..then send all those PDLs a letter telling them not to call you at work..make sure u have it certified..under federal law, they cant harass you at your job..unfortunately, most of them dont care about that law which is why having a certified letter is better..u know what I did..i actually contacted the better business bureau and the attorney generals office and reported them and I included all those in my letter...I have 7 of them and i havent heard of them since...well except for that paydayloan yes, tim atkins whos offering a settlement..lol because its tax time...you'll get over it you'll see

I checked my bank account this morning and the hard debit worked, nothing was debited and my paycheck seems to be safely 'tucked away.' I'm on my way to the local branch to withdrawl everything but $100.00 and as advised I'll make sure the hard debit is put back on the account before leaving. I've decided not to risk staying with the same bank and am planning on opening a new account elsewhere.
I thought I would have all the pdl's (pricipal & amount paid) ready to post but realize I've underestimated how long this will take. The list is getting longer, but I'm determined to get everything out in the open and resolved (at least here, since I've managed to keep this hidden from my husband).

My hubby still does not know and it has been over a year since my first pdl and six months since I have been working on this fourm and working on breaking the cycle. It is nice to know that the people here are rooting you on and are willing to help you no matter what...the biggest thing was there is no judgements..I was angry enough at myself for what I got myself into..everyone was so motivational and postitive which really helped....and they all knew exactly what I was going through.
Problems at the bank - need guidance fast!
Need some advise from anyone from western PA who needed to access their funds after putting a hard block debit on their bank account.
I might be over reacting and just plain paronoid but this is what has transpired so far.

It could be that they weren't showing as pending because the hard debit block was placed on the account. I closed my account and a "deposit only" status was put on the account. If they had a hard debit block it might have worked like a stop and the items were returned before they ever tried to post as "pending" sort of like a stop payment when all of your information is correct.
You might be ok since the debits were supposed to hit today. I doubt any of them will try to redebit tonight becuase it will take them some time to know they were (their ACH debits) were returned by your bank to theirs. Also any ACH items that were represented would show as pending tomorrow for Monday nights hard post. This would hopefully give you enough time to have the bank return them back prior to the hard post.

Well when I wanted to get the remaining funds from my account, the teller just had to call the fraud department to let them ok the debit from my account and it didn't have to remove my block at all. Not sure why they need to lift the block so you can get money....
