PDL wage garnishments

anyone know pdl named CASHLAND?? they sent marshall at my fiance's work. now they cant get hold of him, they go to my parents house. i do believe no one can get arrested for a payday loan, right??

can these pdl do that? send cops/marshalls?? and i believe its for a wage garnishing. but why send marshalls??

if he signed the garnishment papers, can he put that on his bankruptcy?? he filed for chapter 7. theyre on process on starting on it. can he add that garnishment thing on his bankruptcy??


Which state are you from?? To garnish one's wage the lender requires to obtain a judgment against him and not all state allows wage garnishment.

Has a judgment been placed against him already? If he is planning bankruptcy then he may not need to worry about the judgment.

I think we need more information to offer more complete solution.

were in las vegas, nevada. we dont know if he got judgment yet. but we do remember we received a letter dated dec of last yr. we didnt get 2 receive the letter til feb 09. stating he got court order with case #. he diidnt get 2 go to the court because the court date was dec also. we got the letter 2 months later. how can he still attend it??

now theres marshalls looking for him. they even visited his work. his not suppose 2 know that theyre looking for him. his manager was so kind enough to tell him that marshalls are looking for him. and last wednesday, they went to my parents house. well first they left a notice from constable and days later, they showed up to my parents house looking for him. and we dont live with my parents anymore. we live on our own. my dad told me theres cops with the marshall. no one can go to jail for a payday loan right?? we called the office of the marshall who been looking for him, he's hard to get hold of, so we called the constable office. and she told him its about wage garnishment. from CASHLAND. he gonna have to sign the garnishment papers right? even if he is filed for bankruptcy? we are jst waiting for a phone call from some lady now to take his credit counseling.

they sent a marshall to his work??? i mean, they said it was a constable and i am assuming it was to serve the papers for the summons for the wage garnishment? but that is in no way a secret, like in my state anyone over 14 can sign for papers being served.. that just sounds weird to me?

his manager told him some deputy/marshall came to his work looking for him. good thing he was off that day. the manager didnt bother to ask why they looking for him. he didnt wanna be too nosy. the marshall told the manager not to tell my fiance that they are looking for him. we dont know why.a week later, my parents received a notice from the constable..then days later..some marshalls came with cops??? we decided to call the deputy, he is so hard to get hold of, we decided to call the main office. and the lady at front desk told him why the deputy's looking for him. its about a wage garnishment from CASHLAND. now we havent got hold of this marshall guy..same with him..what will happen next?? if my fiance needs to sign the papers, how can we? his down to sign it. were just following wht his attorney said. he's filing for bankruptcy, just sign it and i believe the wage garnish will stop cause he filed for bankruptcy. he just needs to start taking the credit counseling class. we cant get hold of the marshall, when he goes to my parents house, were not there. we live on our own. when we call his number and the office, they say we have to wait for him to return our call. so all we have to do is wait..what happens next if we can never meet up with this marshall???? wil they do/take any legal actions after?? if they still cant get hold of us??? were not hiding or running away. everytime we try to call him, he's not around. looks like we jst have to wait. but at same time it worries me, what wil lhappen if later on we still cant get those papers??

i would call your local sheriff department. they serve papers for wage garnishments and perhpas they can help you locate whoeevr came out. this still does not sound right, though.
i would contact superior court to see what is going on with the wage garnishment. and i would have your husband go in person to pick up the papers. serving papers is not exactly a secret and this just sounds weird..
