Hi I was using PDLs very infrequently since last year, and always repaid them on time. I hated it and vowed never to use them again...then reality and bad luck hit home and going through a nasty divorce, I turned to them to help me get through some difficult times.. same story as just about everyone... now I am totally out of control...my bank account is overdrawn to the tune of $1500 JUST from the bounding PDL debits. I have asked them to stop and I have made moneygram payments which they NEVER post on time... and I am at my wits end. Seriously, I have never been so financially ruined. what can I do?

I have 3 loans..all internet operations as I think PDLs are actually illegal in NC??? .. one from "Sagamore" one from "My Payday Loan" and one from "my cash now"
The principal on Sagamore was $300 MPD loan was $350 and My Cash Now was $375.00. I have paid the MPD and MCN loans down to almost fully paid, then I get financially out of whack with my utilities and bills and then I pay them and the PDLs skyrocket back up to almost 50% more than the original amount!

I am so embarrassed.. I have not viable checking account and I am paying 5% to cash my payroll checks so I am just digging myself deeper.. what can I do? Please! :(

I was in the same situation as you are right except mine were all storefront PDLs...I still have some of them but I least i have some control. about 2 months ago I had 6 PDLs totaling about $4500. I am now down to 3 of them at about $2000 total owed. my bank account is in good standing and I am okay on my bills. I was so overwhelmed back in september I could not deal with all the NSF charges and being behind on PDLs and also my other bills. I would suggest to you that you pick 2 or 3 (or just one, depending on what you can afford) of your PDLs and focus on paying those and forget about the others. once you have paid off those then focus on the others....this is the only way I was able to climb out of the hole I was in.. again, not sure how it will work with online ones since I only had the storefront loans and was able to set up payment plans. I did default on some and was able to work with their collections dept to pay the amount thru a payment arrangement. I am convinced there really is no way around these and you will be in a hole forever unless you focus on just one or two of them at a time. you might want to open up a separate checking account to pay your regular bills out of so those are not bouncing everywhere ...hope this helps :)

North Carolina Internet payday lenders are not legal, either because of restrictive laws, or because the state does not license companies not located in that state, but requires a state issued license to lend. Therefore, none of yours are legal.

I hope the information below will help you. :)
You are only obligated to pay back the principal amount you borrowed from an unlicensed/illegal Internet Payday Lender.
What should you do?
Close your account asap, if you are unable to close your account, go into your bank and ask to speak with the Branch Manager, tell him/her you need a hard debit block placed on your account immediately! Explain that you are revoking ACH authorizations from unlicensed/illegal companies, and have learned these companies are notorious for ignoring revocation, therefore it is important to BLOCK any withdrawal attempts on your account to protect your interest. This is your privilege, do not accept no for an answer. The following link will provide you important information regarding closing accounts. CLICK HERE

What next?
AFTER your account is secure send each pdl (the unlicensed and illegal) an email similar to THIS (please scroll down to locate letter template). Tailor this letter to your needs, and try to write it with the same basic concept in your own words. You will need to research and locate email addresses/physical addresses if you don't already have them, I suggest that you type the name of the pdl (example: "oneclickcash address") in the search box in the upper right hand corner of this forum. You may also search for addresses HERE at the Better Business Bureau.

File complaints: Most of the time, you can file a complaint online with the following, I encourage you to follow through with doing so, you will need to search the Internet for your state Attorney General's website, however, here are links to file complaints for the FTC, Online complaints: Federal Trade Commission., and the BETTER BUSINESS BUREAU.

Keep in mind that you may not receive a response for days, or even weeks, or, you may receive harassing and threatening phone calls. I have found the best way to deal with this is not to respond or reply, simply hang up.

Side note: If you have paid an illegal/unlicensed payday lender above and beyond the principal amount you borrowed, it might be a good idea to demand a refund and a paid in full letter/receipt. You may or may not get one or both. It still doesn't hurt to include that tidbit in your letter. :)
