Texas payday loan help

Ok, I am in texas and have 6 pdl I am about to close my bank account and default on them all but I wanted to make sure I do everything that I'm suppose in order to make this work.

ImpactCash/E-Cash- $300 have paid $270- online

Paychecktoday- $250 have paid $300- online

Cash Advance Network- $250 have paid $275-online

LoanShop- $200 have paid $180- online

GFS- $200 have paid $855- online

BIG- $225 have paid $940- online

Before I close my account am I suppose to contact a processors? I'm really not sure what I need to do. Can someone help?

I have repeatedly asked questions on here and I have yet to see my question answered. It seems that the same questions are always on the 4 pages that have been on here for the past few weeks. How old are these letters and how often is this site updated. It makes me wonder if the information is still current. thanks, but I probably won't see this answered either.

The letters are templates for simply relaying information to the PDL company based on updated PDL state law information. Members and guest add updates a seen fit when questions are posed. Also most visitors who come to this site have no idea on how to address these companies or where to start. So there are handy template letters availible to ease the process and give them a stepping stone. Futhermore, most visitors ask the same questions and post the same information over and over in multiple threads, therefore these template letters where created to give quick responses to their questions. This also explains why you see the same information in many posts. You can find the same information just about anywhere by googling.

Remember this is a community where members and guests share their own personal knowledge based on experience and research. If you like you can do your own personal research and share with us as other members have in the past. Thanks :wink:

-Names of each pdl company.
-Whether they are store front or Internet.

I have a store front loan from Check & Go in Texas. I defaulted on my loan after 2 years and now I am worry that they will send the checks to the DA. A friend of mine got put in jail over check and go. Is this legal?. Husband got layoff and cant do it any longer. Please help !

I have a loan with PLS Loan Stores here in Texas and have paid well over the amount I borrowed. I have been unable to pay on the principle as of yet but have never been late on paying the refinance fees. I have had this loan since... Well I do not remember but it has been a good 4-5 months or longer. I pay 152.30 every two weeks on a regular basis. And I am wondering if there is any way I can get out of this with them. I am on financial ruin if I do not get it taken care of. Any help and advise would be greatly appreciated.

I also have had this problem with a gentleman trying to collect for a pdl.. Not sure of what company he trying to collect for though he said it does nto say in the file. But that the company is seeking criminal charges. At first I was horrified and sent over an intent to pay letter. Which originally he wanted notorized and once i made excuses on why I could not get it notorized said it would be if it was not. I was nto able to pay in full due to non payment from my pell grant. He has since continued to call my cell phone and work place. I have stopped answering his calls and everyone at work has told him I no longer work here. He always says he is going to put my account on hold. My way of thinking is if his "customers" were so intent on collecting and pursuing criminal charges then he would not be able to put it on hold. He calls from one number and leaves another. And a few times I have spoken to him he puts me on "hold" to speak to the attorney and when the person gets on the line it is the exact same guy I was speaking to previously. I have since been informed that since he is not providing adequate information that he is more than likely just a debt collector trying to scare me so he gets his commissions.

I was called today on a loan from 2007 for 500.00 i have paid 700+ to the collection company however they want me to pay another 503.12 to keep me from going to court. I have read all of Lillis posts and feel i do not need to pay them anything else. I live in Texas and have attempted to calculate this myself, however i seem confused-some one tell me if these people can actually take me to court for this

Hi i have 5 payloans and i have consolidated all of them but some of the lenders are saying that they don't work with consolidation companies one is saying they are going to file charges i live int the state of texas//the consolidation company I'm working with said the are just scary tatics.

I defaulted on about $10,000 worth of payday loans, some from the internet, some from storefront locations. With my dad's help, he took all the paperwork to his attny, he then contacted each of the "lenders" and offered a pay off amount, significantly less than what the lenders said I owed. He also issued a cease and desist order to NOT contact me or references. all but 2 declined the offer, we paid the 2, and we have not heard another word from the others and this has been since August 2006! I'm not sure if this is all over or not but it has been a relief to not be stressed over it all. That was the worst stress I had ever put myself through, learned my lesson! Good luck to others1

Please help, they are cutting into the everyday things I need for my family. They keep calling cause my accoutn hit negative when they tired to pull. They call my work, and I don't want them calling my references.

I have a loan with Speedy Cash in the state of Texas for $500 plus and add'l $102 for finance charges. Everytime I go in to pay the finance charges they "renew" the loan as if I had just the loan for the first time. Is this company legal in Texas and is this practice of renewing the loan legal? What should I do if I default?

i also have about 3 new payday loans and now one is calling and threating me in was back in 2000. and one that was piad for but the company ws sold and now they want me to pay again it was paid back in 1994. please help me somebody.:shock:

What if you have a payday loan from a storefront, in which you were scammmed to get, the police are trying to put the scammer in jail, but they said I would still be responsible for the loan, it totals $2090, with check n go, without closing my account, is there a solution? I am paying $470 every other week and it is not going towards my principal. Any ideas?

I have a loan with advance America In Texas and they had some one call me and tell me that i was going to be served papers if I don't make payment arrangements so I made arrangements. I am supposed to pay $50.00 on the first payment and one payment for $97.00 on the other and two payments of $140.00 My loan was in the amount of $350.00 . The called me and on my Cell Phone and I didn't have any thing to write the dates down with. The guy said they would send me a reminder on my cell phone and I never got them but I paid the $50.00 the day I talk to him and I have not received the dates. I have not paid any other payments and this morning I had as law office call Me.
They left a message on my answering machine. I have not called them back just wanting to know my options before I call them and what all they can do to me. Do I need to get a lawyer. Am I going to have to go to court.

If you already made an agreement to make payments and didn't follow through then they CAN and WILL sue you. Make sure the attorney that called you is for real, ask him to send you a letter of collection via the mail, he is required to do this if he is attempting to collect on a debt, that is a federal law (FDCPA) which states a collector of debts must send you a letter of collection via the mail within five days of their first initial contact with you, just explain that you are only exercising your rights and need to know for certain they are legit, therefore, you would prefer a letter of collection so you can exercise your rights. If they are a legit attorney, they will already be aware of the Fair Debt Collection Practices Act. Make sure you keep accurate records of their first contact with you, start a journal, record the phone calls, SOMEthing, just make sure your state laws regarding recording phone conversations, you can check at the link below:

I had seveal payday loans, I settle all loans however I found out yestersday that I had one loan for Cashnet which is an online company thjat i didn't settle. I hadn't recieved any information from this company are a collection agency until yesterday. the call my parents home left a message that I was being give one last time to paid thses debt before the turn it over to brazoria county for legal action and the cost would be thousands. I didn;t know that they could give information to other people. The person gave some ASSOCAITES NAME, I did call them trid to make a settlment however the person was hearing it and told me that I had until tommrow to pay 900 dollars. i don"t have that type of money I'm working partime because of cancer. What can I do.

What state are you in? Is that Cashnetusa or JUST Cashnet, there is a difference, one is legal, the other is NOT. The answer to your question is; a collection agency isn't suppose to divulge personal information about your debt to others, however, if this is an illegal lender I wouldn't expect anything less from them. You need to file complaints against them for not complying with the FTC, BBB and your attorney general's office for not complying with the FDCPA.

My husband and I have 3 payday loans combined. My husband got one while I was out of work, then when he didn't have a job I ended up getting two.
My husbands is from PayDayOne.Com for 600.00 (online).
Mines are from CashStore for 370.00 (in-store) and Approved Money Center for 475.00 (in-store).
My husband just recently got a new job, but it doesn't pay as much as his previous one. We can't afford to pay our bills and for the loans. How do I go about consolidating this debt?!

My husband got a loan with ACE CASH EXPRESS, but has not been able to pay it since he is the only one working. The Collections Recovery Agency is now stating that the will get his supervisor involved in order to get the funds from his paycheck, which is something that we cannot afford to have happen since it will put us in bigger debt. Is it legal for here in Texas for them to do that?

I have found a web site to look up CSO's and if they are registered in Texas

When it pulls up.....in the CSO box put in %cash% and then press the search all button and if there are any registered current, closed, etc organizations registered with TEXAS as CSO's it will be there......You can search with any words just make sure you place the percent(wild card) sign in front of your words and also at the end....

no it is not in fact unless it's for certain debts.(student loans,tax debt,child support).this place can't garnish even with a court order.i would let your boss know about this so they know a bottomfeeder is gonna be calling.so in short they broke the law in threatening you like that.i would file a police report for the call.then file AG,and FTC complaints against this place.then contact ace cash express and see what you can work out.are you sure it was express or services.one is legal.the other is not.this smacks of something services would do or try.

thanks paulmergel. how would we go about filing a police report? What is an AG and a FTC complaint? I am positive that the loan was with ACE CASH EXPRESS? Are they the legal ones that can do this? Your help is greatly appreciated.

Ace Cash Express is usually a legal lenders.

again in TEXAS they can't garnish even with a court order.even legal pdl's can't.you are in a non-granishment state.have your husband give his payroll person the wage assignment revocation letter.then that will be taken care of.btw i would question their legality by stating they will just get money out of your husband's pay by talikng to his boss.highly illegal even in states that allow garnishment.

I am currently stationed in texas I recieved a call from my sister stating onpoint investigative services were looking for me in regards to check fraud. i called the number they left my sister and spoke with a representive saying i am being charged with a misdominor/felony for theft by deception and check fraud for a pay day loan I recieved in 2006 prior to deployment, i asked if I could settle the matter the said yes and told me i owe a balance of $4376.25 for a $500.00 payday loan they assesed attorney fee's late fee's people finding fee's etc..They threated that a warrent is being issued for my arrest if I do not pay the balance n full no payments of any kind when I request paperwork they told me once it gets to their level they have no paperwork to provide me. i am a single mother/soldier of 3 and I do not know what to do. This was so long ago i simply forgot about it and I do not have $4300.00 to just give away. is this legal and can someone please advize me on what I should do. I also asked if they can find my sister why can't they find me and why have they never attepmted to contact me. any response is greatly appriciated. Thank You

here is my response.this is a scam of the first magnitude.file AG,and FTC complaints against this bottomfeeding scuzz.then ignore them.it is your right under the FDCPA to get details in writing for a debt.which is a civil matter,not a criminal one.the FDCPA is a federal set of laws.tell this place to pi$$ on a spark plug.

the internet is a vast tool renee.in fact a roofer who came by our house 2 weeks ago started asking if my sister was interested in roofing,and rattled off her number.the bottomfeeder probably searched your name,and found that info.methinks the info is too accessible in some cases.

I recently took out a loan with zip19.com and due to something beyond my control, I defaulted. I want to pay them back but they are requesting a total amount of $417.94 ($300 principal, $56.49 fees and $61.45 for extra fees, I guess). They have contacted me by phone and I told them I would pay but needed it broken down into payments. Today someone called my HR department to verify employment; I called the number back that they left with the HR director and guy named Lucus Morrison told me that he only verified employment and that I would have to call 866-567-0888. Called this number and was told the entire balance had to be paid. Since they are not licensed in Texas, can I get by with sending them payments to pay off the principal and then send a cease letter so that they won't contact me at work, at home or Hr department by phone?

You only owe them the principal amount you borrowed, they aren't entitled to interest and fees since they aren't licensed to lend. Ask them for a valid address, I would do all this via email because if you call them they will only threaten and try to scare you. CLICK HERE to find out how to deal with illegal lenders.
