Payday Loan Help
Date: Fri, 11/28/2008 - 06:20
I've been getting calls from HPC in Jacksonville, FL about some of the loans and I paid one off already, and so far 1 from Approved has popped up for $366.75.
The first time HPC called my girlfriend talked to him and he said since my checking account was closed I could go to jail if I didn't pay the full amount or at least half by 5pm that same day. I managed half and paid the rest 2 weeks later.
I've done some research and gotten the information on payday lending in Virginia and it says that criminal action is prohibited and collections fees are $25 NSF, court costs, and reasonable attorneys fees (not to exceed $250)
Now when HPC calls he usually says that the creditor has only given him so much time to give me before he has to turn things over to the court in Virginia, he says the regardless of where I'm at now they could come arrest me at home or at work.
On the $366.75 he says it's due in full by Dec. 26, I get two paychecks by then and still have car insurance, rent, power bills, etc.. to pay plus Christmas for my kids, he's only going to accept 2 payments since the amount us under $1,000.
I have two payday loans open with Approved and when I called to pay off a different payday loan he said that this one for $366.75 just came in, I'm worried that if I can pay this one off in time that I'll call and he'll say another one popped up that has to be paid by the end of the year.
My questions is what can actually happen if I'm unable to pay these amounts he's asking by the date given?
Thanks for your help,
:(

Has HPC sent you a dunning letter yet,(CLICK HERE for a sample dunning letter, scroll down). If not, then the next time they call you need to inform them that according to the fdcpa they have 5 days after the first intitial contact to send you a dunning letter in the mail, give them an address where they can send it. After you recieve your dunning letter, you will have 30 (thirty) days to respond, at this time you can send them a debt validation letter (CLICK HERE for a sample debt validation letter and CLICK HERE to read about the FDCPA. This will at least buy you some time so you are able to set up some type of payment arrangements that you can afford. Good luck!
