I thought I paid this account off in Aug. or Sept, 2004. But now I heard from a collection company regarding the balance.

You can check your recent credit report to verify the current state of that account. Also, you can send a debt validation request to the collection agency that is contacting you. If the agency comes up with enough proof in support of their demand, then only you need to pay it.

HI,
I've been having trouble w/collections over a Providian acct. from 1999 that just recently resurfaced after not hearing anything for a couple of years. My # is on your list, however I don't know the end of it. The other difference is the address I have is from Pleasanton, CA. (I'm getting this info from my credit report). The collection agent kept quoting me a balance > $2000, yet what's on my credit report of 9/22/05 is $1334--orig. bal.$751. I made him an offer of what I could afford to pay monthly but he refused stating he'd take nothing < $100. I'm disabled and my only income is SSDI, which is bupkis. I believe he's sending it to the lawyers now.
Do I qualify for this Providian pay-down thing @ 8%? I'm new to this site and don't understand all the abbreviations yet, but if I read it right do they not wipe out some of the accrued interest as of a certain date?
Or should I just let it go to court :cry: and believe in a system that's screwed me before. My lawyer says "Even a judge can't get blood from a stone!".
I anxiously await your reply.

You might be benefited from the counseling session that you're going to get by registering with this site. The consultant could help you a lot to settle your debt with lower amount and reduce the rate of interest as much as possible.

debt consolidation companies sometimes refuse to work for the accounts that are under judgment. So try to keep the account current if possible.

You can lodge complaint against them with BBB, FTC or DA's Office. BBB and FTC provide the option to file complaint online.

Visit them at bbb.org and ftc.gov

Also browse this forum thoroughly; it will help you to know how to hold this situation and how to deal with these companies as well.

Does anyone have any current info regarding the first post? Maybe a website or something. I had an account with them that they sold to Collect America, LTD. I am getting back on my feet and would like to pay back what I owe and the above post looks like it would be better then what the collection agency is offering. Also, if you can explain the pros and cons of such an offer would be of great help. Thanks

I have this address of their California branch. If the account is sold to the collection agency, then the original creditors might not be accepting any payments from you. You might be interested in pulling your latest credit report from the three bureaus and see the latest standing of the said account.

While you deal with any agency that is holding your debt, ask them to give you the complete statement of this account or get the debt validated. You will be sure of getting the account in accurate shape before you finally agree to any payment plan. Once validated, request for splitting the payments so that it becomes easier in paying it off.

Thank you for your help!

Well I told these people that I need something in writing back in Aug or there would be NO more payments made.

To my surprise 3 weeks ago, this company calls my cell, leaves a very rude and threatening voice mail saying how they are going to throw my dh in jail. Needlessto say I got wise to their tactics and knwo they are committing a crime by this. I call their office and low and behold NO mention fo the supposed Prosecuting attys office they claimed to be. They seem to think tho, just because they are attys, they are prosecuting ones.. HELLO you arent a freaking county office. I hate liars.

Anyways, with that said, I stood my ground, let them knwo that I wasnt going to be bullied. I have been waiting since AUg 18th for some kind of paper saying what company, what amount was agreed and what paymetns have been made. Until that paper was in my hand, they werent getting diddley! I figured, just an empty promise, but they sent it. LOL Everything I wanted to be in the letter is. I told them it is my way now.. dont like it, oh well.

I still think I am going to turn them into the BBB and all those. They are commiting illegal collections.

I just want this done and over with. UGH!

This collection agency isnt on his credit report at all. I cant get Providian to talk with me, they say the acct is in collections. I just want to make srue that after my payments are made, then it will show as paid.

On another note, since you said that. The acct on the credit says 1200 and some change, but their balance is 2100 and something. we agreed to 1800, maybe we agreed to too much. Hmm.. maybe I will try to call them again.

What do you suggest?

You need to negotiate with the collection agency for a better payment plan. Consider this that your account is already in collections. Thus, your credit report has already been tarnished and they can't damage it any further. So, you are in the stronger side of a sound negotiation.

I am looking to settle my debt to providian. CRedit files show it as a charge off, but i have not heard from anybody in years and Providian cannot get me any information, any ideas out there??

Charge-off status is considered as a negative mark. You should try to make it better. It's true that you cannot remove it from your credit file; however, paid charge-off will make it well again.

Try to contact Providian and check if they are still holding your account or not. Make suitable repayment arrangements.

They might have sold the debt to some debt buyer to collection agency also. In that case you have to contact the current owner of the account. If you want to avoid all these hassles, just enroll in consolidation program and the company will negotiate with your creditors on your behalf.
